Explanation

advowson

The right of patronage or presentation to a church benefice.

allocate, writ of

A writ authorizing allowance to be made by the officers of the Ex. of a specified amount: often this amount is to be off-set against the debts owed to the K. by the beneficiary.

alterage

A form of affinity proscribed in late medieval Ireland between the Irish and the English, whereby a man stood sponsor for a child at baptism; (also) gossipred.

assize

Technical term for legal proceedings or various kinds. See mort d’ancestor, novel disseisin.

avener [Lat. avarius]

provider of oats, esp. for the household of the K. or his chief governor

avoirdupois

Miscellaneous merchandise sold by weight.

bonnaght [Ir. buannacht]

The billeting of mercenaries or servants.

cask

See tun.

certiorari, writ of

Letters close issued by the K. to his officers commanding them to supply information to him concerning a specified matter, normally by searching the records.

chattels

Property, goods, money: as opposed to real property (land).

dicker [Lat. dacra]

A measure of 10 hides.

dower

Portion (one third) of a deceased husband’s estate which the law allows to his widow for her life.

escheat

The reversion of land to the lord of the fee to the crown on failure of heirs of the owner or on his outlawry.

extent

A survey and valuation of property, esp. one made by royal inquisition.

falding [Ir. fallaing]

A kind of coarse woollen cloth produced in Ireland; the mantle or cloak made from the same.

fee-farm
 

A fixed annual rent payable to the K. by chartered boroughs.

fotmel [Lat. fotmellum]

A measure of lead.

engrossment

Technical term: the action of writing out, for instance patent letters and charters; (also) the documents thus written out.

enrolment

Technical term: the action of recording in the records of the K., esp. the registering of a deed, memorandum, recognizance; (also) the specific item or record thus enrolled.

hanaper

A repository for the keeping of money. The ‘clerk of the hanaper in chancery’ was the chancery official responsible for the receipt of fines for the issue, engrossment and ensealing of writs, patents and charters issued by the chancery.

herberger [Lat. herbergerius, hospitator]

One sent on before to purvey lodgings for an army, a royal train (OED).

galangal [AN galyngale]

The aromatic rhizome of certain Asian plants of the genera Alpinia and Kaempferia, of the ginger family, used in cookery and herbal medicine; (also) any of these plants (OED).

generosus [Lat.]

Term designating social status: translated as ‘gentleman’.

king's widow [Lat. vidua regis]

The widow of a tenant in chief: so called because whe was not allowed to marry a second time without royal licence.

knights’ fees

Units of assessment of estates in land. Originally a single knight’s fee was the amount of land for which the military service of one knight (=knight service) was required by the crown. ‘Fee’ derives from the Latin feudum, which in other contexts translated as ‘fief’. In practice the descent of landed estates meant that many knights’ fees came to be subdivided and, in the later Middle Ages, personal service was frequently commuted to money payments (=scutage).

liberate, writ of

A chancery writ issued to the treasurer and chamberlains of the Ex. authorizing them to make payment of a specified amount, often the annual fees, wages and rewards of the K.’s officers.

linch [Lat. lincia]

A measure of tin.

livery

The delivery of seisin, or possession, of an estate hitherto held in the K.’s hand, for instance when a minor reaches the age of majority.

mainprize

Legal term: the action of undertaking to stand surety (=‘mainpernor’) for another person; the action of making oneself legally responsible for the fulfilment of a contract or undertaking by another person (OED).

mass [Lat. messa]

A standard measure of metal.

messuage

A portion of land occupied, or intended to be occupied, as the site for a dwelling house; (also) a dwelling house together with outbuildings and the adjacent land assigned to its use (OED).

mort d’ancestor, assize of [Lat. assisa mortis antecessoris]

A legal process to recover land of which the plaintiff’s ancestor (father, mother, uncle, aunt, brother sister, nephew or niece) died seised (=in possession), possession of which was since taken by another person.

nolumus, clause of [Lat. cum clausula nolumus]

A standard clause inserted especially in letters of protection by which pleas and suits are delayed for a specified period of time.

novel disseisin, assize of [Lat. assisa nove disseisine]

A legal process to recover land from which the plaintiff claims to have been dispossessed (=disseised).

pensa See wey.
piece [L. pecia] A standard quantity of merchandise.
pendent seal Seal hanging from engrossed letters patent attached to a tongue or tag of parchment.
perpresture An illegal encroachment upon royal property.
plica A fold along the foot of engrossed letters patent and charters to create a double thickness of parchment, used for attaching the ‘great seal pendent’ to the letters. An incision was made in the plica and through which a tag of parchment was attached. A wax impression of a seal was then affixed to the tag.
protection An act of grace by the K., granted by chancery letters, by which the recipient is to be free from suits at law for a specified term; granted especially to persons crossing overseas or otherwise out of reach of the courts in the K.’s service.
quare impedit, writ of An action brought to recover the advowson of a benefice, brought by the patron against the bishop or other person hindering the presentation.
scutage The commutation of personal military service to the crown for a money payment. Normally called ‘royal service’ in Ireland.
seisin Formal legal possession of land.
sendal [Lat. cendallum; ME cendal] A thin rich silken material (OED).
stallage [Lat. stallagium, estallagium] Payment for a market stall.
tun [Latdolium] A large cask or barrel, esp. of wine.
valettus A term designating social status: translated ‘yeoman’.
Vidua Regis [Lat.] See King's widow.
volumus, clause of [Lat. cum clausula volumus] A standard clause inserted esp. in letters of protection by which pleas and suits are delayed for a specified period of time. In full the clause runs: volumus quod interim sit quietus de omnibus placitis et querelis (=we wish that meanwhile he be quit of all pleas and plaints).
waif A piece of property which is found ownerless and which, if unclaimed within a fixed period after due notice given, falls to the lord.
waivery [AN weiverie] The technical term for proceedings of outlawry in the case of women.
wey [Lat. pensa, peisa, pisa] A standard of dry-goods weight.
worsted [ME wyrstede] A woollen fabric or stuff made from well-twisted yarn spun of long-staple wool combed to lay the fibres parallel (OED).
writ [Lat. brevis] Letters close containing commands by the K. to certain specified persons, esp. royal officers. Returnable writs, which were not normally enrolled in the chancery rolls, were to be returned by the officer to chancery with details of the actions taken by the officer in response to the contents. See also allocate, certiorari, liberate.

William Wellesley has pleaded that, at the request of the Lt and council of Ire., on 10 March [1382] 5 Ric. II he undertook the governance of the castle and lordship of Carbury taking 200m p.a. when others used to take 400m p.a., for which governance he sustained many damages expenses and losses. Because this remuneration is insufficient, he seeks remedy. On the advice of the Lt and council, the K. has granted him £20 of his gift. ORDER to pay him that sum.

Alexander [Balscot], bp Ossory, has shown by petition displayed before Lt and council that on 10 Feb. [1383] last by letters patent the K. appointed the bishop as deputy of the Lt because of the Lt's age, and also as chief justice of pleas following the Lt, to do all that pertains to that office taking 13s 4d a day for his wages while he held the office. The bishop laboured in Munster and Leinster and elsewhere in Ire. on account of these offices in the K.'s wars and in making of peace between his English lieges and Irish enemies and English rebels from 10 Feb. onwards, on account of which a better tranquillity at present pertains in those parts thanks to his mediation. The bishop sustained many expenses beyond his wages and also lost of horses to the sum of 40m and more in labouring in these offices. He seeks remedy. Having consideration for the above, the K. granted him 40m of our gift. ORDER to pay him that sum.

The K.'s clerk Robert Sutton has pleaded that on 1 June [1380] 3 Ric. II by letters patent the K. appointed him clerk of the hanaper of the chancery of Ire. receiving all money owing and to be paid to the said hanaper, so that he should answer at the Ex. for the said money, as is contained in the letters. Robert held the said office from the said 1 June to 18 Feb. [1381] 4 Ric. II accounted for money levied and received in the hanaper at the Ex. and rendered his account as in the details of the account rendered at the Ex. Robert seeks remedy for his labours in that office. Having consideration for his plea, the K. granted him 8m of his gift. ORDER to pay him that sum.

The K. has considered the costs and labours of brother William Tany, prior of the hospital of St John of Jerusalem in Ire., C., in various marches of Ire. with a large number of defensible men in his company on various parleys with the K.'s Irish enemies and rebels in those parts for the K.'s peace and the tranquillity of our lieges, so that he was continually occupied on these matters and others touching the K. and his subjects. And he obtained nothing from the K. beyond his fee as C., although other chancellors used to maintain a number of men-at-arms and archers in their company at the K.'s wages. Wishing that the C. should be compensated for his expenses and labours, the K. has granted him £20 of his gift. ORDER to pay him that sum.

John Lumbard and Robert Sutton have pleaded that they were appointed as justices to hear and determine certain seditions, felonies, trespasses and other matters in co. Wexford, as is more fully contained in the K.'s letters patent, and that they held a session at Taghmon in the marches of that county for five whole weeks at their own expense with 16 men and horse in their company to resist the Irish there. And for the K.'s advantage they collected 40m and more in that session, as appears in the estreats in the Irish Ex. They seek reward. The K. lately wished to be informed as to how much was answered for at the Ex. of two thirds of £20 of rent in the town of Drogheda and two thirds of £46 13s 4d p.a. of the farm of that town from the issues of two thirds of certain lands, with appurtenances, in co. Dublin that belonged to John Coterell kt, which were held by Nicholas Gernoun for life as in the K.'s letters patent granting them to him, viz. from Michaelmas [1383] last, which were all seized in the K.'s hands by reason of the absence of Nicholas from Ire. against the ordinance promulgated in parliament at Westminster against possessors of lands in Ire. not staying in that land for the defence of same. The K. ordered the T. and barons of the Ex. to search the rolls and memoranda of the Ex. concerning the sum paid to the K., and to return their findings to the K. in the chancery of Ire. They returned that it is agreed that £22 4s 5d were answered for in the Ex. And it is agreed by inspection of the rolls of the Irish chancery that on 15 April [1383] last, the K.'s hand was removed from the said two thirds of the rent, the £46 13s 4d, and the said lands by virtue of a writ of Eng. dated 9 Aug. [1383] 7 Ric. II to the then Jcr, C., T., barons of the Ex. and chamberlains. Wishing that justice be done to Nicholas, ORDER to pay him, his attorney or his deputy the said £22 4s 5d.

John Symcok, formerly mayor of the city of Waterford, has shown that John and Donatus, sons of William Odwyr, and Molaghlyn s. of Mkraigh Omolryan, formerly hostages for the K.'s peace were delivered to Edmund Mortimer, late earl of March and Ulster Lt; and the Lt sent the hostages to John, then mayor of the K.'s city, for safe keeping at the K.'s expense. John received them by letters of the Lt under his p.s. asking that he might keep the hostages at reasonable expenses of the K.; and John kept the hostages for 36 weeks at his own expense by virtue of the said letters. He seeks his expenses in sustaining the said hostages. Wishing to do what is just towards John, we grant John Symcok 10m of our gift for the above reasons. ORDER to pay him the said 10m.

Walter s. of Hugh Golding has petitioned that his father, Hugh, whose heir he is, was lately seised in fee of 1 messuage and 1 carucate in Chicheton near Rathlagh, held of Roger [Mortimer], late earl of March, dcd, by knight service, as of his manor of Trim, held of Edward III in chief by knight service. Hugh died leaving Walter as a minor, and after his death the said messuage and land were seized into the K.'s hand because of the minority of Edmund [Mortimer], son of the said earl, and remained in the K.'s hand until the K. ordered by writ that the same should be delivered to Walter after proof of his age. And because the said Walter married without licence while under age and in the present K.'s custody, the said messuage and lands were seized again and are now in the K.'s hands. The K. has granted a pardon, for a fine, to Walter for that marriage. ORDER not to trouble him.

For [a fine of] £106 13s 4d paid by Walter Reynolds, the K. granted Walter custody of two thirds of all lands and tenements that belonged to Walter Lenfaunt who held in chief in Ardee and elsewhere in cos. Louth and Kildare, with knights' fees, advowsons [etc.], and custody of the reversion of one third of the said lands that Elena, widow of Walter, holds in dower with knights' fees [etc.]. Those two thirds were in the K.'s hand by reason of the death of Walter and the minority of Thomas, his son and heir. The K. also granted custody of all lands and tenements of John Haddesore dcd in Keppok, co. Louth, held of Walter in chief, in the K.'s hand by reason of John's death and the minority of James his heir, together with the reversion of one third of the same, to have until the respective heirs come of age, together with their marriages without disparagement. ORDER to exonerate him of that sum, which has been received.

Obreen Shamagh, the K.'s Irish enemy, and other enemies and rebels of the K. in Munster have now lately arisen to war against the faithful lieges of those parts, daily perpetrating homicides, depredations and burnings in those parts and proposing to make a general conquest of the said parts (which God forbid!) unless they are speedily restrained from their malice with God's aid and a strong hand. ORDER to cause it to be proclaimed that all and singular tenants of the K. by royal service when scutage runs royal service within co. Limerick should be at Kilmallock on St David the Bishop [1 March 1384] before the K.'s beloved and faithful Philip Courtenay, Lt of Ire., suitably and sufficiently armed and arrayed to proceed in the Lt's company as ordered by the Lt.
