Maurice fitz Thomas, e. Kildare, has shown by his petition displayed before the the Jcr and council in Ire. that lately, at the request of the Jcr of Ire., he travelled on an expedition against the Irish of Slemargy in the company of the Jcr, with a great company of men-at-arms, archers, hobelars, horse and foot, at his own excessive costs, so that he could not return to his household but remained in the marches among the enemy. He seeks remedy. The K. has granted him of 40s of his gift by name of reward. ORDER to pay him that sum.1

Explanation

advowson

The right of patronage or presentation to a church benefice.

allocate, writ of

A writ authorizing allowance to be made by the officers of the Ex. of a specified amount: often this amount is to be off-set against the debts owed to the K. by the beneficiary.

alterage

A form of affinity proscribed in late medieval Ireland between the Irish and the English, whereby a man stood sponsor for a child at baptism; (also) gossipred.

assize

Technical term for legal proceedings or various kinds. See mort d’ancestor, novel disseisin.

avener [Lat. avarius]

provider of oats, esp. for the household of the K. or his chief governor

avoirdupois

Miscellaneous merchandise sold by weight.

bonnaght [Ir. buannacht]

The billeting of mercenaries or servants.

cask

See tun.

certiorari, writ of

Letters close issued by the K. to his officers commanding them to supply information to him concerning a specified matter, normally by searching the records.

chattels

Property, goods, money: as opposed to real property (land).

dicker [Lat. dacra]

A measure of 10 hides.

dower

Portion (one third) of a deceased husband’s estate which the law allows to his widow for her life.

escheat

The reversion of land to the lord of the fee to the crown on failure of heirs of the owner or on his outlawry.

extent

A survey and valuation of property, esp. one made by royal inquisition.

falding [Ir. fallaing]

A kind of coarse woollen cloth produced in Ireland; the mantle or cloak made from the same.

fee-farm
 

A fixed annual rent payable to the K. by chartered boroughs.

fotmel [Lat. fotmellum]

A measure of lead.

engrossment

Technical term: the action of writing out, for instance patent letters and charters; (also) the documents thus written out.

enrolment

Technical term: the action of recording in the records of the K., esp. the registering of a deed, memorandum, recognizance; (also) the specific item or record thus enrolled.

hanaper

A repository for the keeping of money. The ‘clerk of the hanaper in chancery’ was the chancery official responsible for the receipt of fines for the issue, engrossment and ensealing of writs, patents and charters issued by the chancery.

herberger [Lat. herbergerius, hospitator]

One sent on before to purvey lodgings for an army, a royal train (OED).

galangal [AN galyngale]

The aromatic rhizome of certain Asian plants of the genera Alpinia and Kaempferia, of the ginger family, used in cookery and herbal medicine; (also) any of these plants (OED).

generosus [Lat.]

Term designating social status: translated as ‘gentleman’.

king's widow [Lat. vidua regis]

The widow of a tenant in chief: so called because whe was not allowed to marry a second time without royal licence.

knights’ fees

Units of assessment of estates in land. Originally a single knight’s fee was the amount of land for which the military service of one knight (=knight service) was required by the crown. ‘Fee’ derives from the Latin feudum, which in other contexts translated as ‘fief’. In practice the descent of landed estates meant that many knights’ fees came to be subdivided and, in the later Middle Ages, personal service was frequently commuted to money payments (=scutage).

liberate, writ of

A chancery writ issued to the treasurer and chamberlains of the Ex. authorizing them to make payment of a specified amount, often the annual fees, wages and rewards of the K.’s officers.

linch [Lat. lincia]

A measure of tin.

livery

The delivery of seisin, or possession, of an estate hitherto held in the K.’s hand, for instance when a minor reaches the age of majority.

mainprize

Legal term: the action of undertaking to stand surety (=‘mainpernor’) for another person; the action of making oneself legally responsible for the fulfilment of a contract or undertaking by another person (OED).

mass [Lat. messa]

A standard measure of metal.

messuage

A portion of land occupied, or intended to be occupied, as the site for a dwelling house; (also) a dwelling house together with outbuildings and the adjacent land assigned to its use (OED).

mort d’ancestor, assize of [Lat. assisa mortis antecessoris]

A legal process to recover land of which the plaintiff’s ancestor (father, mother, uncle, aunt, brother sister, nephew or niece) died seised (=in possession), possession of which was since taken by another person.

nolumus, clause of [Lat. cum clausula nolumus]

A standard clause inserted especially in letters of protection by which pleas and suits are delayed for a specified period of time.

novel disseisin, assize of [Lat. assisa nove disseisine]

A legal process to recover land from which the plaintiff claims to have been dispossessed (=disseised).

pensa See wey.
piece [L. pecia] A standard quantity of merchandise.
pendent seal Seal hanging from engrossed letters patent attached to a tongue or tag of parchment.
perpresture An illegal encroachment upon royal property.
plica A fold along the foot of engrossed letters patent and charters to create a double thickness of parchment, used for attaching the ‘great seal pendent’ to the letters. An incision was made in the plica and through which a tag of parchment was attached. A wax impression of a seal was then affixed to the tag.
protection An act of grace by the K., granted by chancery letters, by which the recipient is to be free from suits at law for a specified term; granted especially to persons crossing overseas or otherwise out of reach of the courts in the K.’s service.
quare impedit, writ of An action brought to recover the advowson of a benefice, brought by the patron against the bishop or other person hindering the presentation.
scutage The commutation of personal military service to the crown for a money payment. Normally called ‘royal service’ in Ireland.
seisin Formal legal possession of land.
sendal [Lat. cendallum; ME cendal] A thin rich silken material (OED).
stallage [Lat. stallagium, estallagium] Payment for a market stall.
tun [Latdolium] A large cask or barrel, esp. of wine.
valettus A term designating social status: translated ‘yeoman’.
Vidua Regis [Lat.] See King's widow.
volumus, clause of [Lat. cum clausula volumus] A standard clause inserted esp. in letters of protection by which pleas and suits are delayed for a specified period of time. In full the clause runs: volumus quod interim sit quietus de omnibus placitis et querelis (=we wish that meanwhile he be quit of all pleas and plaints).
waif A piece of property which is found ownerless and which, if unclaimed within a fixed period after due notice given, falls to the lord.
waivery [AN weiverie] The technical term for proceedings of outlawry in the case of women.
wey [Lat. pensa, peisa, pisa] A standard of dry-goods weight.
worsted [ME wyrstede] A woollen fabric or stuff made from well-twisted yarn spun of long-staple wool combed to lay the fibres parallel (OED).
writ [Lat. brevis] Letters close containing commands by the K. to certain specified persons, esp. royal officers. Returnable writs, which were not normally enrolled in the chancery rolls, were to be returned by the officer to chancery with details of the actions taken by the officer in response to the contents. See also allocate, certiorari, liberate.

Arthurus s. of Dermicius McMorgh of Okenseley has shown by his petition displayed before the Jcr and council in parliament that he remained personally at Dublin and elsewhere for five weeks with 14 men and horses in his company answerable to the K.'s council to take part in the K.'s wars in Leinster, at great expense. He seeks a suitable reward. The K. has granted him 100s of his gift by name of reward. ORDER to pay him that sum.

Maurice Tanner, burgess of Arklow, has shown by his petition displayed before before the Jcr and council that William fitz William, constable of Wicklow castle, took and arrested a barge belonging to Maurice, with its rigging [apparatu], sailors and men, in order to carry victuals from the K.'s city of Dublin to that castle for the sustenance of the men of the castle, for the safekeeping of the same, by virtue of a mandate of the K. That barge was wrecked and lost while sailing to the castle because of a storm, to Maurice's loss. He seeks reward in aid of his sustenance and so that he might acquire another barge to bring victuals to Arklow castle, which is situated among the K.'s Irish enemies. Considering Maurice's damages, losses and poverty, and on advice of the Jcr and council, the K. has granted him 100s of his gift. ORDER to pay him that sum.

The K. wished to be informed concerning the amount of arrears owed to the prior of the convent of the order of friars of Mount Carmel, Leighlin, from those 10m granted to him on 3 Dec. [1372] 46 Edw. III on the advice of the K.'s council in Ire. for the relief and rebuilding of his abode [in reedificacionem habitacionis sue], to be received of the K.'s alms each year at the Ex. during pleasure. The K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. and return their findings in chancery under their seal without delay. They returned that the arrears amount to 10m for Easter and Michaelmas 47 Edw. III [1373]; the same for 48 Edw. III [1374]; and the same for 49 Edw. III [1375], viz. £13 13s 4d for three years; and they are in arrears of 10m for Easter and Michaelmas 50 Edw. III [1376]. Wishing that satisfaction be made, ORDER to pay the prior and convent the said £13 13s 4d.

Wishing lately to be informed concerning the amount of arrears owed to Richard Plunket, K.'s pleader, of those 100s p.a. granted to him while he holds that office, the K. ordered the T. and chamberlains of the Ex. to search the rolls and memoranda of the Ex. and return their findings in chancery. They returned that it is agreed that Richard's arrears of that fee amount to the following: £17 8s 4d from 18 April [1371] 45 Edw. III until 18 Jan. [1375] 48 Edw. III, viz. 3¾ years; and £10 from the said 18 Jan. [1375] until 18 Jan. [1377] last, viz. 2 years. Wishing that satisfaction be made to Richard for that sum, ORDER to pay him 17 8s 4d and the £10.

Thomas Taillour clk has pleaded that at the first killing of the men of the town of Carlow last year by the K.'s Irish enemies and rebels of Leinster [ad primam occisionem hominis ville de Catherlagh in anno proximo preterito per hibernicos inimicos et rebelles nostros partium Lagenie factam] a certain horse of his worth 100s was killed by those enemies in the rescue of the K.'s lieges of that town; and that at the last burning of that town perpetrated by the K.'s said enemies [ad ultimam arsionem ville predicte per eosdem inimicos nostros perpetratam], he suffered many damages to his great impoverishment. He seeks a suitable reward in recompense for his damages and losses. Being favourably inclined to his petition and accepting that it is the truth, the K. has granted 60s to Thomas of his gift and on advice of the council. ORDER to pay Thomas that sum.

John Brettan, remembrancer of the Ex., has shown by his petition before the Jcr and council of Ire. that on 2 Oct. [1369] 43 Edw. III by letters patent of the chancery of Ire. the K. appointed him as one of the barons of the Ex. to do all and singular things pertaining to that office without receiving any fee from the K. in this part. On account of those letters John has laboured from the said 2 Oct. [1369] until the present from various parts of Ire. to the town of Carlow where the Ex. was situated, both in time of war when other barons dared not go there, and also in time of peace when the said barons were occupied in the K.'s service judging and continuing pleas of the crown pending in the Ex. He also served the K. in the office of remembrancer for a long time at his own costs and expenses, without reward beyond the fee of 100s p.a. He sustained many damages and injuries in these services at the time of the last burning of that town by the K.'s Irish enemies and rebels of Leinster when they burned and despoiled his houses and various goods there to his considerable damage and impoverishment. He seeks reward for his labours, expenses and damages. Believing that this is true and being favourably inclined to his plea, the K. has granted him 100s of his gift on the advice of the Jcr and council. ORDER to pay him that sum.

Thomas Bathe, clerk appointed to pay the wages of men-at-arms, hobelars, horse and foot in the K.'s service in Ire., was ordered on advice of the Jcr and others of the K.'s council there to go to Eng. to inform the K. concerning certain matters concerning the state of Ire., and especially concerning the pursuit of the receipt and payment of fees and wages of the K.'s retinue in the company of James Butler, e. Ormond, Jcr, for the second half of the year [51 Edw. III], according to the form of the indenture made between the Jcr and the K. concerning that retinue. The K. has granted Thomas 20m as an aid for his expenses in the K.'s service. ORDER to pay him those 20m.

It was found by inquisition taken before John Wydon', formerly mayor of Dublin; William fitz William, then sheriff of Dublin; and Henry Michell K.'s attorney that John Scrope had in pawn [in pignus] from the Carmelite friars of Dublin a silver pot and a gold cloth worth £10 for an agreed sum of 32s. And after the death of John, these goods came into the hand of the bishop as the then T. of Ire. ORDER that, having received those 32s from the friars, he is to deliver to them their cloth and pot.

Robert Holywood, formerly chief baron of the Ex., has shown by his petition before the Jcr and council in the K.'s parliament held at Dublin on Thursday after Epiphany last [8 Jan. 1377] that the K. ordered him by writ of Eng. to be before him and his council in Eng. on a certain day to inform him concerning the state and governance of Ire., as is contained in that writ; on account of which he crossed to Eng. and remained there for Trinity and Michaelmas terms at the K.'s request. He asks to be paid his fee and reward for that time for his office. Being favourable to his request, the K. has granted him his fee and reward to have until someone is appointed his deputy in that office. ORDER to pay Robert that fee and reward until 23 Nov. The prior and brethren of the order of Friars Preachers in that city have pleaded to the K. by their petition displayed in the parliament held at Dublin on Thursday after Epiphany last [8 Jan. 1377] that the K. granted the mayor, bailiffs and community of Limerick the farm of that city, together with rents, customs, services and other things belonging or pertaining to the K. in that city for a certain term of years, to be received by their deputies in aid of the repair and improvement of the walls and other fortifications of that city, as is contained the K.'s letters patent. There are still four years remaining of that term. Although the house [mansio] of the friars preachers is situated next to the walls of the city, and a part of the city is enclosed by the same house, the mayor and citizens would not grant them part of the farm, rents [etc.] in aid of the repair and improvement of their house and the enclosing of the walls of that city, which threaten to fall down unless they receive help; and the said prior and brethren are not sufficient to repair them, as they say. So that the prior and brethren can repair their buildings, the K. has granted them 40s of rent from tenements in Mynoter Corbaly, which is a parcel of the rent granted to the mayor [etc.] to have for as long as the grant of the farm [etc.] lasts. ORDER to permit the prior and brethren to take that rent, notwithstanding the K.'s grant to them.

The K. wished to be informed concerning the reason for taking into his hand 40 acres of land in Cnokanton and 49 acres in Valleston which belonged to Geoffrey Cogan dcd in co. Cork. It was returned that Peter s. of Peter Cogan dcd, who held in chief, granted those lands by his letters patent to the said Geoffrey for a term of 24 years, without having obtained the K.'s licence. This reason was considered insufficient. ORDER to remove the K.'s hand and interfere no further in those lands if they were seized for no other reason.

Simon Cusak kt has shown by his petition displayed before the Jcr and council that he has sustained great costs and various labours in the K.'s service both in Munster at the time when John Cusak, his father, died, and elsewhere in Ire., both in horses, arms and men lost and killed, and also in lands and tenements burnt and despoiled. And now lately a certain Simon captured Moriertagh Redi,1 a notorious felon, who has despoiled, robbed and burned many of the K.'s lieges in Munster, Leinster and Fyngall; and he brought him to the prison of Trim castle where he was hanged. On account of this various other felons and friends of Moriertagh have committed various depredations and robberies on Simon's houses and lands, and they continue to do so daily. And Simon also paid £50 into the Ex. from a debt owed to the K. by his father,2 of which debt there are still 37m remaining. Because he received no reward for the premises, he asks to be excused those 37m. In consideration of the premises and for his good service, the K. has granted Simon 10m of his gift. ORDER to pay him that sum.

MEMORANDUM that in parliament held at Dublin on Thursday after Epiphany last [8 Jan. 1377] Arthurus s. of Dermicius McMorgh of Kenseley personally appearing before James Butler, e. Ormond, Jcr, and the K.'s council there mainprized for himself and the men of his kindred and adherence that henceforth they would maintain themselves well and faithfully towards the K. and his lieges, and would keep the K.'s peace; and that they would make war with the K. with all his power against those arising against the K. and his faithful lieges; and that he would remain faithfully with the K. for one year, viz. from the Purification of the Virgin Mary next [2 Feb. 1377] until the same feast the following year, as is more fully contained in the indentures made between the K. and Arthurus, taking 40m p.a. from the K., of which 20m ought to be paid beforehand. And a letters have been sent to the T. and chamberlains of the Ex. ordering them to pay Arthurus the said sum and the remainder of the 40m at a certain time specified in those indentures.1

Arthurus s. of Dermicius McMorgh of Okenseley, chieftain of his lineage, became the K.'s liegeman and was received into the K.'s peace. On the advice of the K.'s council in Ire., the K. retained him to fight against the Irish who make war in Leinster, with all his following. For this reason, the K. granted him 40m p.a. for his wages and fees for himself and his men beginning at the Purification of the Virgin Mary next [2 Feb. 1377], viz. receiving each portion in certain terms as appears in the indenture.1 ORDER to pay Arthurus 20m in part-payment of those 40m.

Wexford, Kilkenny, Carlow and Kildare; and he is unwilling to be restored to the K.'s peace without payment of that fee. In order to avoid the damages and perils arising from his rebellion, it was agreed and granted by the Jcr and council that the K. should retain Art' for one year next beginning at the Purification of the Virgin Mary next [2 Feb. 1377] and that the Jcr should satisfy him of 20m for the first quarter; such that the K. will not be charged with the payment of the said fee to Art' beyond that quarter. The K. has learned by inquisition that Peter Cogan, lately deceased, was seised in his demesne as of fee on the day he died of two thirds of 1 messauge, 4 carucates and 40 acres of land, and £20 of rent, in Moymethan, Roysrath, Nord[… …], Malkyneston, Lysgewyn, Balliassid, Clynnanyerth, Kilmadragh, Newelond, Fothengton, Moyalawerth, Ballaath, and Kallaghrath in co. Cork, and 2 water mills in Moymethan and Ballaath; and that they are worth £4 5s p.a. and no more on account of the destruction of the Geraldines [Geraldinensium]; and he was also seised of the manor of Mora in the said county worth nothing because of the destruction of the Barretts; and of two thirds of the moiety of the manor of Sandon in Ocourblethan in the said county, worth 20s 7d p.a.; and of the town of Ballaath in the said county, worth 49s 4d p.a.; all of which were held of others who held of the crown in chief.1 Peter died on Wednesday next before St Margaret 45 Edw. III [1371]; and Phillip s. of William Barry kt occupied the lands [etc.] aforesaid from the time of Peter’s death by K.’s letters patent. John fitz David Roche kt and William Roche kt are Peter’s next heirs and of full age. They seek restoration of the premises.

ORDER to the escheator that, having made a legal partition of the lands [etc.] into two equal portions, he is remove the K.’s hand from the portion belonging to John [fitz David Roche]. Because William [Roche] was indicted and outlawed for various felonies committed by him against the K.’s peace, all his lands and tenements were recognized as belonging to the K. by forfeiture; and therefore, ORDER to seize all his portion into the K.’s hand together with his other lands, and to answer for the issues at the Ex. And he is to send the partition thus made under his seal without delay into chancery, so that it might be enrolled there, as was usual.

Maurice fitz Thomas, e. Kildare, has shown by his petition displayed before the Jcr and others of the K.'s council in Ire. in parliament last held at Dublin [?8 Jan. 1377] that when he was keeper of Ire., Richard Porter, then clerk appointed to pay the wages of men-at-arms, hobelars, archers [etc.] staying in the keeper's company, received £281 2½d from the earl for the K.'s use as a loan for the payment of those wages. And the said Richard, in rendering his account before the T. and barons of the Ex., charged himself with the sum, and paid it with the surplus in his account. Of that sum £217 14s ¾d remains to be paid to the earl; and the said clerk has made recognizance before the T. and barons of the Ex. that the said sum is owed to the earl, as more fully appears in the remembrancer's roll in the Ex. For this reason, the earl seeks payment of that sum.

The K. ordered the T. and barons to search the rolls and other memoranda in the Ex. concerning the above, returning their findings to the K. in chancery. The T. and barons returned that it was found in the great roll of 48 Edw. III [1374–5] in the account of Richard [Porter] there that Richard had a surplus of £281 2½d; and on 12 Feb. [1376] 50 Edw. III, Richard acknowledged that he borrowed £275 17s 8½d from the earl to pay wages in furtherance of the war in Munster. That sum is owed to the earl, as is contained in the memoranda rolls of the Ex. for 50 Edw. III [1376–7], among the records for Hilary term. And £58 3s 7¼d were paid to the earl at the receipt of the Ex.; so that £217 14s ¾d remain to be paid to the earl.

Wishing that satisfaction be made, ORDER to pay the earl the said £217 14s ¾d.

In consideration of the burdens and expenses they have incurred in repairing and securing the town against the K.'s enemies, the K. has granted them the custom due in that city called the 'Coket', to hold and receive for ten years, as is contained in the K.'s letters patent of Eng., with the intention of repairing the quays of that city and enclosing the city against his enemies. Now the K. has learned that various enemies of his, both from Spain [de Ispania] and elsewhere, perceiving that the city is not secure and enclosed from the water side, intend to attack it from the water. Wishing to avoid such damage and danger, ORDER, by the faith and loyalty in which they owe to the K. and under threat of forfeiture, to enclose the city with all haste, and to repair the quays lest run and loss be cause to the city by the lack of such repairs and enclosure. And they are to omit nothing, under pain of forfeiture.

MEMORANDUM that Tirrelagh Obreen of Thomond, chieftain of his lineage, came to the city of Cork by order of the Jcr of Ire. to treat concerning the restoration of the peace between the K.'s faithful lieges of Cork and Limerick and the Irish of the said parts;1 and he stayed there with various men in his company for several days at his own great expense. On the advice of the Jcr and council at Cork, it is agreed that he should have 50s of the K.'s gift in aid of his costs. And letters are to be made in chancery ordering the T. and chamberlains of the Ex. to pay Tirrelagh those 20s.1

To the sovereign and provost of the town of Galway, and other burgesses and merchants in that town.

On 10 May [1375] 49 Edw. III, with the advice of the council in Ire., the K. ordained that his staple of wool, leather, woolfells and other merchandise was granted to that town for three years, and customs were to be paid at that town and not at Cork for that term, notwithstanding the K.'s order that the staple was to be at Cork, Dublin, Drogheda and Waterford, and not elsewhere in Ire.; and at the end of that term all customs were to be paid at Cork and not at Galway unless provision was made otherwise in the meantime. Although that term is not yet complete, the K. ordered by his letters patent under the g.s. of Eng. dated 9 Sept. [1376] last that the Jcr, C. and T. and others of the council to cause it to be proclaimed in all towns that the said staple was to be held at Dublin, Waterford, Cork and Drogheda, and not elsewhere in Ire., and no one was to presume it elsewhere under pain of forfeiture.

ORDER therefore to proclaim that all mercahnts accustomed to paying their customs at Galway are hereafter to pay them at Cork. Nor are they to permit such customs to be paid in Galway, and similarly customs on their merchandise is to be paid at Cork. NOTIFICATION also that the K. had it proclaimed in all ports in his land and overseas that any ships with merchandise for which customs have not been paid in Dublin, Wateford, Cork or Drogheda shall be forfeited. ORDER to seize the seal called the 'Coket' in the custody of Nicholas Calf, burgess of that town, deputy of the bishop of Meath, collector of those customs in Galway, and bring it before the T. and chamberlains of the Ex. at Carlow with all speed, to be deposited in the treasury.

Although the K. granted the staple to Galway [as in §57] and the office of collector of customs in the port of Galway had been granted to Stephen [Valle], bp Meath, with Nicholas Calf, burgess of Galway as his deputy exercising all the duties of that office and also custody of the K.'s seal called the 'Coket'; now the K. has ordered that the staple is to be at Dublin, Waterford, Cork and Drogheda, and not elsewhere in Ire.; and customs are not to be paid at Galway but at Cork. The K. has ordered the sovereign and provost to receive the seal called the 'Coket' from Nicholas in a purse [in bursa] under his seal, and to bring it before the T. and chamberlains of the Ex. at Carlow with all speed to be deposited in the K.'s treasury there. ORDER, under pain of forfeiture, to hand over that seal without delay to the sovereign and provost in a purse under his seal by indentures to be made between him and themselves; and he is nt to interfere concerning that office any further.

In the K.'s parliament at Kilkenny on the morrow of Trinity 49 Edw. III [18 June 1375] it was agreed and ordained by William Windsor, then governor and keeper of Ire., and others of the K.'s council in Ire. appearing there that at the end of that parliament Stephen [Valle], bp Meath, should proceed in person in the governor's company to Thomond and Connacht, and remain there upon the maintenance of the K.'s war against Obreen of Thomond and others adhering to him—who were then threatening to make a general conquest in those parts—and for the restoration of the peace for as long as might be necessary, with as many men-at-arms, hobelars, archers, horse and foot in his company as seemed necessary, from time to time, for the maintenance of the war and the restoration of the peace, at the wages and fees ordained and granted in the K.'s council held at Naas on 7 Sept. [1374] previously, to be taken by the hands of the clerk of the wages deputed by the K. to this or the T. and chamberlains of the Ex., viz. 13s 4d a day for himself and the accustomed wages in that land for each man-at-arms, hobelar, archer, horse and foot, just as is more fully contained in a certain memorandum on this enrolled in the K.'s chancery of Ire.

Now it has been reported on behalf of that bishop that although he spent much time in the K.'s service, by virtue of the said agreement and ordinance; and although John Lumbard was appointed in that parliament to act as controller [ad contrarotulandum] for the bishop and the men-at-arms [etc.] in his company; yet John did not act as controller, both because he was occupied in the K.'s service on various arduous business and also because he did not possess a commission to act as controller for the bishop and the men-at-arms [etc.]. Therefore bishop humbly seeks payment of the wages for himself and men-at-arms for the time that he was in the K.'s service.

The K. ordered the T. and barons of the Ex., to account with the bishop, by his oath taken before them concerning this, for how many days and with how many men of men-at-arms [etc.] and for the amount of time he spent upon the war and restoration of the peace, informing the K. in chancery without delay of the amount that reasonably owed by the K. They returned that it was reckoned that the bishop remained in those parts from 8 July [1375] 49 Edw. III until 1 Sept. following, viz. 56 days inclusive; and from 16 Dec. [1375] 49 Edw. III until 23 Jan. [1376] 50 Edw. III, viz 44 days inclusive, with 10 men-at-arms and 20 hobelars and archers, the bishop taking 13s 4d a day, each man-at-arms taking 12d a day, and each hobelar and archer 6d a day. And the bishop retained in his company in those parts 100 foot from 27 May [1376] 50 Edw. III until 29 July following, viz. 64 days, each two captains each taking 4d a day; and each of the other foot taking 2d a day. The total of wages for the said time amounts to £821 and 16d.

Wishing that the bishop be satisfied of that sum, ORDER to pay him the said £821 and 16d.

John Brettan, chief remembrancer of the Ex., has shown by his petition before the Jcr and council that he was appointed by letters patent and ordered to go to Munster in the company of Alexander [Balscot], bp Ossory, T. of Ire., to levy and hasten [ad levanda et acceleranda] the K.'s debts in those parts, and do other things for the K.'s advantage. On account of this order, he spent 35 days in those parts without receiving any reward or wage from the K. He seeks that he be granted the wages for that time which other officials customarily received. And because the T. has testified before the Jcr and council that John was in his service in those parts for that time, the K. has granted him on the adviceof the Jcr and council 2s a day for each of those 35 days, which amounts to 70s. ORDER to pay John that sum.

John Penkeston, clerk of the common pleas in the Ex., has shown by his petition displayed before the Jcr and council that after the death of Robert Baynard, late clerk of the said common pleas, viz. on 20 Feb. [1376] 50 Edw. III, he was ordained by the C., T. and barons and other ministers of the Ex. to serve the K. in that office, taking 5m p.a. for his fee. At that time he swore before those ministers that he would serve the K. and his faithful lieges well and faithfully. By virtue of this, he served faithfully in that office from the said 20 Feb. and afterwards at his own expense without receiving any fee. He seeks payment of the said 5m for that time and for the future for as long as he holds that office. Being favourably inclined to his petition and learning the truth of his petition, the K. has granted to John, on the advice of the Jcr and council, the arrears of his fee of 5m, as well as his fee of 5m while he holds that office. ORDER to cause him to be paid his arrears and to have that fee in the future.

Having consideration for the destruction, burning and devastation of the town of Adare by the Irish, and so that the town might be better and more securely built, the K. has granted to the provost and community, at the request of Maurice fitz Thomas, e. Kildare, lord of that town, that they may be quit of any subsidies, tallages and other services due and accustomed. ORDER, under pain of forfeiture, not to compel or distrain the provost and community of Adare to contribute or pay those subsidies [etc.] until the town is fully repaired and rebuilt, but to exonerate and acquit them totally in the mean time; and they are to relax any distraint already made.

It appears by an inquisition returned into chancery that one Thomas Bodenham was lately seised as of fee of 2 messuages, 30 acres of land and 6 acres of wood in Crumlin, which he held of the K in chief by service of half a pound of pepper at Christmas and suit at court. Thomas was imprisoned at Dublin by one Robert Tyrell and so detained until coerced by his imprisonment he enfeoffed one John Wake, chaplain, of the said tenements, who later enfeoffed Robert thereof according to the said Robert's orders, without obtaining the K.'s licence; and after the same Thomas was released from prison he personally intruded upon the said Robert in those tenements, and died seised thereof on Saturday next before All Saints 22 Edward II [25 Oct. 1348]. After Thomas's death, Robert intruded into those tenements himself, and received the profits until the day he died, viz. for seven years and more. And after Robert's death, one Richard Tyrell, a bastard, entered them and occupied them until the said tenements were seized into the K.'s hand because of the enfeoffment without licence; and one Robert Talbot, s. of Juliana Bodenham, daughter of the said Thomas, is Thomas's heir and of full age. ORDER to cause Robert [Talbot] to have full seisin of the said tenements.

Thomas Clifford kt, sheriff of Limerick, has shown by his petition in parliament at Dublin on Thursday after Epiphany last [8 Jan. 1377] that he was ordered by the K.'s writs to appear with other prelates, magnates and peers in that parliament and also to be before the T. and barons of the Ex. at Carlow in the quindene of Hilary to render faithfully his account of the issues of co. Limerick. Because he has been so ill and gravely infirm for a long time that he was detained and still is detained because he was unable in any way to labour on said the days and places without great danger to his life, as can be faithfully testified by Stephen [Valle] bp Meath and trustworthy of that county. He pleads that he be excused for his absence from that parliament and the Ex., and he seeks respite of his account for a certain time. As it has been testified by various faithful persons in the chancery of Ire. that the premises are true, the K., of his special grace, has excused Thomas for his absence at parliament and in the Ex., and has granted him respite of his account until the quindene of Easter. ORDER to permit him to have that respite, and not to amerce Thomas for absence at the quindene of Hilary nor to trouble him in any way.

Patrick Cathassagh was lately accused of defamation by John abbot of Degty in court Christian before the archdeacon of Meath, and Patrick was excommunicated. Patrick appealed from that sentence to the apostolic see at Rome. Now on behalf of Patrick the K. has learned by petition that notwithstanding the pending appeal, Patrick at the signification of the bishop of Meath has been seized and imprisoned without justice, to his great damage. Not wishing that Patrick be seized without reason, ORDER that if Patrick finds sufficient mainpernors before the seneschal who will mainprize to have him before the K. in chancery in the quindene of Easter to answer the bishop and abbot, and to do anything else deemed necessary, then the seneschal is to deliver him from prison, and to have there the names of the mainpernors and this writ.

By grave complaint of S[tephen Valle], bp Meath, the K. has learned that Ocongh[y]r Offaly, Mauricius Mole McChugh, Conghyr Obenys and others of their company and following, having contempt for God and the peace and tranquillity of the church have despoiled and destroyed various manors, lands and demesnes of that bishop and his church while he was in the K.'s service in Munster, to the grave damage of the bishop and his church. For this, they have incurred the sentence of excommunication, since they have no intention of ceasing their evil or of making satisfaction to the bishop. ORDER to excommunicate them, put them under interdict and expel them from the church and communion of Christ, in public places where people are gathered, and to punish them by ecclesiastical censure. There punish is to serve as an example to others, and the bishop is not to lift the excommunication and interdict until they make satisfaction for the damages and injuries done to the bishop.

Alexander [Balscot], bp Ossory, has shown that he held all his temporalities of the K. in chief and obtained a market in his town of Irishtown [del Iryshton] near Kilkenny, which is part of his temporalities, viz. every Wednesday. And although the bishop and his predecessors were accustomed to bring goods for sale to the market and to the liberty within the crosslands without paying any customs for the murage of the town of Kilkenny from the time of the founding of the church of St Canice in Kilkenny, the sovereign, provost and community of the town of Kilkenny have unjustly taken customs for the murage of Kilkenny on those goods without the bishop's consent, to the grave damage of the bishop and the disruption of his market and liberty. He seeks remedy.

According to an inquisition held by William Tany, C. of Ire., and remaining in the chancery, it is agreed that Irishtown is part of the temporalities of the bishop and the bishop and his predecessors were accustomed to hold the market and liberty in that town. Not wishing prejudice to that bishop by reason of the K.'s letters, ORDER not to enter that market or liberty nor to take customs on goods entering the same without the assent of the bishop.

By advice of the Jcr and others of the K.'s council of Ire., and with the assent of the magnates and commons of co. Cork, it was agreed that Gerald Boy1 s. of Raymond s. of Peter Caunton and Edmund fitz Geraud Caunton, who are detained in the gaol of Cork, should be released and exchanged for David s. of David Barry kt and Milo Staunton, magnates of that county, who are detained in the prison of the said Raymond [s. of Peter Caunton] and his men. And that Gerald and Edward should remain in their custody in the K.'s gaol until David and Milo are fully released from Raymond's prison. ORDER, on pain of £100, to produce Gerald and Edmund at Youghal on Wednesday next after St Bartholomew [26 Aug. 1377] to deliver them to the Jcr, notwithstanding the K.'s former orders from Eng. to the contrary.

The abbot of Tracton has shown by his petition displayed before the Jcr and council that he was ordered to appear with other prelates, magnates and peers at the last parliament held at Dublin [?8 Jan. 1377]. At the time of that parliament he was so infirm of body that he could neither appear in that parliament nor proceed to that city without peril to his body and his life; and he appointed and ordained William St Leger as his attorney, granting him sufficient powers to do and execute on his behalf in that parliament all and singular things that the abbot would have done had he been present in person. And although he did this, he was amerced in £10 for failing to attend in person. Those £10 have been placed in the estreats of the Ex. among the K.'s other debts to be levied from the abbot. He seeks that, having considered the premises, the K. might deign to pardon the said amercement and postpone the levying of the same. And because that amercement was adjudged in full parliament with the advice of the prelates and magnates, so that it can in no way be pardoned without their advice in another parliament or great council to be held in the future, the K. has granted the abbot respite and adjournment of the levying of that amercement until the quindenes of Easter [1378] so that he can sue for a pardon in a parliament or great council held in the meantime. ORDER to permit the said postponement until the quindene of Easter, and not to trouble him by reason of the premises in the meantime.

Thomas Cadelle has pleaded by his petition displayed to the Jcr and council in parliament at Dublin on Thursday next after Epiphany [8 Jan. 1377] that for many years now elapsed and especially during the last war stirred up against the K.'s faithful lieges by les Omorthes, McMorghs, Onolans et Obrynnes, the K.'s Irish enemies, he has stayed continually on the marches of cos. Kildare and Carlow resisting and repressing the said enemies, and continues to do so, together with a great company of hobelars and foot. He has incurred and sustained great costs, expenses, labours and losses both by the slaying of his men and horses in various expeditions made upon the K.'s said enemies or made by them upon the K.'s said lieges; and also in sustaining and retaining the said hobelars and foot; and he cannot do so any longer without a suitable reward from the K. so that he might better retain and sustain them in the future. Considering his labours, costs and losses and on the advice of the Jcr and council, the K. has granted him 5m of his gift by name of reward. ORDER to pay him that sum.

Geoffrey Tryvers, David Tryvers and John fitz Rery have pleaded by their petition displayed to [William Windsor] governor and keeper of Ire., and others of the K.'s council in parliament at Kilkenny in the octaves of Michaelmas 49 Edw. III [6 Oct. 1375] that they paid 100s to various scouts [exploratores] and also incurred other costs and labours in tracking down various malefactors who perpetrated and continue to perpetrate felonies and trespasses in cos. Dublin, Meath and Kildare, so that the K.'s faithful people of those parts were disturbed and aggrieved by their excessive malice, as a result of which many of those malefactors were caught and detained, others were hanged, and (God willing) still others will be taken in the future. They seek a suitable reward in recompense of their costs and expenses. Being favourably inclined to their plea and on the advice of the governor and council, the K. has granted them £10 by name of reward to have and receive from the goods and chattels of those malefactors forfeited or to be forfeited and taken and seized into the K.'s hand in cos. Dublin and Meath, to be appraised by the said John [fitz Rery]. Although Alexander [Balscot], bp Ossory, T. of Ire., together with [William Tany] prior of the hospital of St John of Jerusalem in Ire., C., was lately ordered by the advice of the Jcr and council in Ire. to proceed to the K. and his council in Eng. to expound and declare before them upon the state of his land of Ire., nevertheless the T. did not cross to Eng. for the following reasons:

[1] because of a certain discord now lately arisen between Gerald fitz Morice, e. Desmond, and various others of his party [ex parte sua], and Richard Burgh kt and David Burgh and various others of their party,
also on account of a great many discords and other damages and evils stirring in various parts of Ire. requiring to be settled and pacified; and also for other most urgent matters which could not be concluded properly in the absence of the T.;
[2] and also because the gold owed to the Jcr and his retinue for the second half of 51 Edw. III [1377] for their wages and fees, according to the indenture made between the K. and the Jcr, has not been sent from Eng., and all and singular of the men of the Jcr's retinue staying in the K.'s service upon his wars in Ire.—who are awaiting payment of their fees and wages for a quindene and more beyond the first half of that year, and have not taken anything until now while staying in the K.'s service in Ire.—intend to withdraw that service unless the K. provides an aid for their expenses and relief of their estate until the gold is sent; and if the retinue should disband, intolerable damages and evils will, without doubt, be perpetrated by the K.'s Irish enemies and English rebels and other malefactors on the K.'s faithful people, without the presence of the council and the aid of the T.

Therefore on the advice of the Jcr and council at Waterford, 20 April [1377] 50 Edw. III, considering the said urgent necessity, it was agreed that the T. should not cross the sea, but that he should expedite the said matters in various parts of Munster, and that a writ of the K. should be sent to the T. lest he should cross the sea for those reasons, as is contained in a certain memorandum in the chancery rolls.1 Afterwards the T. pleaded that on the advice and order of the Jcr and council he proposed to cross the sea, and waited in Waterford and elsewhere for his passage for 19 days because of contrary winds; and freighted a ship for his passage. Now, on the advice of the Jcr and council he was ordered by writ not to cross the sea, and he seeks adequate recompense for his expenses concerning his passage. Because the Jcr and council are satisfied that this was the truth, the K. has granted him 20m of his gift. ORDER to pay him.

Stephen [Valle], bp Meath, has shown by his petition displayed before the Jcr and council that on 1 April [1375] 49 Edw. III the K. granted him custody of all the castles, fortresses, manors, lands and tenements that belonged to John Hastings, e. Pembroke, dcd, who held of the K. in chief, with their appurtenances, in co. Wexford, which were taken into the K.'s hand on the death of the earl and by reason of the minority of his heir; rendering annually to the K. at the Ex. the next extent thereof to be made. Although the castles [etc.] were duly extended before the escheator, and the extents returned by him into the chancery of Ire. so that the bishop could be charged in the Ex. with the issues in his account according to the extent, nevertheless, having viewed the extents, certain enemies of the bishop informed the council that the lands had not been extended to the K.'s profit nor to the true value, and on their advice the K. appointed Richard Walsh and John Brettan, ministers of the Ex., to extend the castles [etc.] anew. Now the bishop is charged with answering in his account for the extents thus made by Richard and John to the true value and more, against the form and effect of the K.'s letters patent granting that custody to him. and the T. and barons refuse and will not allow in his account a suitable sum for the expenses of receivers and other servants of the bishop who took expenses of £10 and more from the bishop for the time that he held that custody. He pleads that considering how the castles [etc.] are extended at their true value and more, and having respect for the great expenses and labours that the bishop has sustained in that custody in levying and receiving the rents and other issues, as is said, that he might be granted a suitable reward. [1376] 50 Edw. III, he [John] was appointed by the C. and T. of Ire., and the barons and other ministers of the Ex. for the time being, to serve the K. in that office, receiving 5m annually for his fee, at which time he swore to serve the K. and his faithful people well and faithfully in that office; by virtue of which he has faithfully served the K. in that office from the said 20 Feb. at his own costs without receiving any fee in that part. Alexander [Balscot], bp Ossory, has pleaded by his petition displayed before the Jcr and council that lately on the advice and ordinance of the Jcr and council he was appointed by letters patent to proceed to the K.'s city of Limerick to settle and pacify certain debates and discords that had arisen between Gerald fitz Morice, e. Desmond, and various others of his party [ex parte sua], and Richard Burgh kt and David Burgh and various others of their party. On account of the danger of the roads and to save the K.'s honour in this part, he proceeded to that city with a great force of defensible men beyond his household to labour upon the reformation of the peace there among [those parties] and for the peace and tranquillity of the K.'s faithful people in Munster, and he remained there for those reasons; and thence to Cork for nine days at his own expense. He seeks a suitable reward in recompense for his expenses, as agreed by the Jcr and council. As the Jcr and council are satisfied as to the truth of the premises, the K. has granted him £9, viz. 20s a day, of his gift. ORDER to pay him that sum.

Walter Lenfaunt has shown by his petition before the Jcr and council that lately he was sworn in order to attend the council [ad consilium nostrum observandum iuratus extitit]; and from the time of his swearing he remained continually in the K.'s service in the company of the Jcr on the advice and ordinance of the Jcr and council, and he proceeded from Cork to Limerick and he remained there for several days upon various treatings specially concerning the maintenance of the peace and the tranquillity of the K.'s faithful people there at his own expense without receiving anything from the K. Art' Kevenagh, who pretends to be captain of the Irish of Leinster claiming 80m p.a. from the K. for his fee, having gathered to himself a multitude of the Irish of those parts, has perpetrated various homicides, depredations, burnings and other evils on the K.'s people in cos. Wexford, Kilkenny, Carlow and Kildare; and he is unwilling to be restored to the K.'s peace without payment of that fee. Wishing to avoid the damages and perils arising from his rebellion, the K. has retained Art' on the advice of the Jcr and council in Ire. for one year next and granted him 20m for the first quarter of a year. As Art' has maintained himself well and faithfully towards the K. since then is granted 20m of his fee for the second quarter, always such that, by the payment of that fee to Art', the K. shall in no way be charged beyond the said quarter. ORDER to pay him those 20m.

Wishing lately to be informed concerning the arrears owed to Henry Michell, lately one of the K.'s justices with S[tephen Valle], bp Meath, John fitz Rery and Patrick Fox, also justices appointed to hear and determine concerning all trespasses and felonies perpetrated in cos. Waterford, Tipperary, Cork, Limerick and Kerry of those 40d a day that he received while holding that office, the K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. and, having viewed the account of the said John, the K.'s clerk appointed to collect his debts in those counties and to pay Henry the said 40d a day, they were to return their findings in chancery. They returned that no record of any payment to Henry can be found in the rolls; but that it was found in the great roll of 49 Edward III [1375–6] in John's account that he paid Henry £7 3s 10d in part-payment of £21 3s 4d for his wages from 6 Oct. [1374] 48 Edw. III until 9 Feb. [1375] following, viz. 107 days taking 3s 4d a day; and Henry's arrears amount to £13 9s 6d.
