Explanation

advowson

The right of patronage or presentation to a church benefice.

allocate, writ of

A writ authorizing allowance to be made by the officers of the Ex. of a specified amount: often this amount is to be off-set against the debts owed to the K. by the beneficiary.

alterage

A form of affinity proscribed in late medieval Ireland between the Irish and the English, whereby a man stood sponsor for a child at baptism; (also) gossipred.

assize

Technical term for legal proceedings or various kinds. See mort d’ancestor, novel disseisin.

avener [Lat. avarius]

provider of oats, esp. for the household of the K. or his chief governor

avoirdupois

Miscellaneous merchandise sold by weight.

bonnaght [Ir. buannacht]

The billeting of mercenaries or servants.

cask

See tun.

certiorari, writ of

Letters close issued by the K. to his officers commanding them to supply information to him concerning a specified matter, normally by searching the records.

chattels

Property, goods, money: as opposed to real property (land).

dicker [Lat. dacra]

A measure of 10 hides.

dower

Portion (one third) of a deceased husband’s estate which the law allows to his widow for her life.

escheat

The reversion of land to the lord of the fee to the crown on failure of heirs of the owner or on his outlawry.

extent

A survey and valuation of property, esp. one made by royal inquisition.

falding [Ir. fallaing]

A kind of coarse woollen cloth produced in Ireland; the mantle or cloak made from the same.

fee-farm
 

A fixed annual rent payable to the K. by chartered boroughs.

fotmel [Lat. fotmellum]

A measure of lead.

engrossment

Technical term: the action of writing out, for instance patent letters and charters; (also) the documents thus written out.

enrolment

Technical term: the action of recording in the records of the K., esp. the registering of a deed, memorandum, recognizance; (also) the specific item or record thus enrolled.

hanaper

A repository for the keeping of money. The ‘clerk of the hanaper in chancery’ was the chancery official responsible for the receipt of fines for the issue, engrossment and ensealing of writs, patents and charters issued by the chancery.

herberger [Lat. herbergerius, hospitator]

One sent on before to purvey lodgings for an army, a royal train (OED).

galangal [AN galyngale]

The aromatic rhizome of certain Asian plants of the genera Alpinia and Kaempferia, of the ginger family, used in cookery and herbal medicine; (also) any of these plants (OED).

generosus [Lat.]

Term designating social status: translated as ‘gentleman’.

king's widow [Lat. vidua regis]

The widow of a tenant in chief: so called because whe was not allowed to marry a second time without royal licence.

knights’ fees

Units of assessment of estates in land. Originally a single knight’s fee was the amount of land for which the military service of one knight (=knight service) was required by the crown. ‘Fee’ derives from the Latin feudum, which in other contexts translated as ‘fief’. In practice the descent of landed estates meant that many knights’ fees came to be subdivided and, in the later Middle Ages, personal service was frequently commuted to money payments (=scutage).

liberate, writ of

A chancery writ issued to the treasurer and chamberlains of the Ex. authorizing them to make payment of a specified amount, often the annual fees, wages and rewards of the K.’s officers.

linch [Lat. lincia]

A measure of tin.

livery

The delivery of seisin, or possession, of an estate hitherto held in the K.’s hand, for instance when a minor reaches the age of majority.

mainprize

Legal term: the action of undertaking to stand surety (=‘mainpernor’) for another person; the action of making oneself legally responsible for the fulfilment of a contract or undertaking by another person (OED).

mass [Lat. messa]

A standard measure of metal.

messuage

A portion of land occupied, or intended to be occupied, as the site for a dwelling house; (also) a dwelling house together with outbuildings and the adjacent land assigned to its use (OED).

mort d’ancestor, assize of [Lat. assisa mortis antecessoris]

A legal process to recover land of which the plaintiff’s ancestor (father, mother, uncle, aunt, brother sister, nephew or niece) died seised (=in possession), possession of which was since taken by another person.

nolumus, clause of [Lat. cum clausula nolumus]

A standard clause inserted especially in letters of protection by which pleas and suits are delayed for a specified period of time.

novel disseisin, assize of [Lat. assisa nove disseisine]

A legal process to recover land from which the plaintiff claims to have been dispossessed (=disseised).

pensa See wey.
piece [L. pecia] A standard quantity of merchandise.
pendent seal Seal hanging from engrossed letters patent attached to a tongue or tag of parchment.
perpresture An illegal encroachment upon royal property.
plica A fold along the foot of engrossed letters patent and charters to create a double thickness of parchment, used for attaching the ‘great seal pendent’ to the letters. An incision was made in the plica and through which a tag of parchment was attached. A wax impression of a seal was then affixed to the tag.
protection An act of grace by the K., granted by chancery letters, by which the recipient is to be free from suits at law for a specified term; granted especially to persons crossing overseas or otherwise out of reach of the courts in the K.’s service.
quare impedit, writ of An action brought to recover the advowson of a benefice, brought by the patron against the bishop or other person hindering the presentation.
scutage The commutation of personal military service to the crown for a money payment. Normally called ‘royal service’ in Ireland.
seisin Formal legal possession of land.
sendal [Lat. cendallum; ME cendal] A thin rich silken material (OED).
stallage [Lat. stallagium, estallagium] Payment for a market stall.
tun [Latdolium] A large cask or barrel, esp. of wine.
valettus A term designating social status: translated ‘yeoman’.
Vidua Regis [Lat.] See King's widow.
volumus, clause of [Lat. cum clausula volumus] A standard clause inserted esp. in letters of protection by which pleas and suits are delayed for a specified period of time. In full the clause runs: volumus quod interim sit quietus de omnibus placitis et querelis (=we wish that meanwhile he be quit of all pleas and plaints).
waif A piece of property which is found ownerless and which, if unclaimed within a fixed period after due notice given, falls to the lord.
waivery [AN weiverie] The technical term for proceedings of outlawry in the case of women.
wey [Lat. pensa, peisa, pisa] A standard of dry-goods weight.
worsted [ME wyrstede] A woollen fabric or stuff made from well-twisted yarn spun of long-staple wool combed to lay the fibres parallel (OED).
writ [Lat. brevis] Letters close containing commands by the K. to certain specified persons, esp. royal officers. Returnable writs, which were not normally enrolled in the chancery rolls, were to be returned by the officer to chancery with details of the actions taken by the officer in response to the contents. See also allocate, certiorari, liberate.

On 15 June [1368] 42 Edw. III, Edward III, late K. of Eng., grandfather of the present K., granted to Reginald Lovell by letters patent custody of the manor of Esker in Ire., to hold during pleasure with all appurtenances, rendering its true value annually at the Irish Ex. at Michaelmas and Easter in equal portions according to the extent made or to be made thereof. The K. granted to Reginald that he should have 12d a day for life of the issues of the said manor and that the 12d should be allotted him in the extent annually while he has the custody. On 6 Dec. [1377] last, the present K. confirmed, approved and accepted those letters. Wishing to be informed as to the amount owed to Reginald of the said 12d a day in the time of Edward III and that of the present K., the K. ordered the T. and barons of the Ex. to search the rolls and memoranda of the Ex. of Ire. concerning the premises, returning their findings to the K. in the chancery of Ire. without delay. They returned that it was found that Reginald is owed £11 11s 6d from the time of Edward III from the eve of All Saints 50 Edw. III [31 Oct. 1376] until 20 June [1377] 51 Edw. III, viz. half a year and seven weeks inclusive, and that he is similarly owed £36 12s from the time of the present K. from 21 June [1377] 1 Ric. II until 23 June [1378] last, viz. for 2 years [recte 1 year] 2 days inclusive of the first day but not the last. Wishing that satisfaction be made to Reginald, ORDER to pay him £11 11s 6d and £36 12s.

Castledermot
To the T. and chamberlains of the Ex.

Robert [Wikeford], abp Dublin, has pleaded that he was at Castledermot and was fully informed of the malice and intention of the Irish enemies and rebels then openly at war to destroy the town, and on the advice of certain persons on the K.'s council he ordered Geoffrey Vale to remain there with a certain number of his men in his company for the salvation and defence of the town. The archbishop paid out of his own money 12m in various amounts for the wages of the men and 40s for the safe custody of the fortalice of Kenlyeston [Kindlestown], which was burned by the Irish. He seeks satisfaction. Wishing to do what is just, ORDER you to pay the archbishop the 12m and the 40s.

John Dawe of Carlow pleads that he was ordered by [John Young, bp Leighlin] deputy of the T. to remain at Carlow with two men for the salvation and defence of that town when all the Irish enemies were openly at war for 13 weeks, without receiving anything for his expenses; and also that his horse worth £10 was killed on an expedition led by the Jcr against the Irish of Leys [Laois] for the protection of the K.'s lieges, to John's impoverishment. He seeks reward for the above reasons, in relief of his estate. On the advice of the council, the K. has granted 4m to John of his gift. ORDER to pay him that sum.

Brother William Tany, prior of the hospital of St John of Jerusalem in Ire., has shown that Edward III, late K. of Eng., granted by English letters patent that the prior might retain 6 men-at-arms and 12 archers in his company at Edward III's wages while he was C. of that K. in Ire. By virtue of this, the prior retained the said men-at-arms and archers; and afterwards when the prior went to Eng. on business concerning Edward III and the prior, they were in the company of his deputy, Matthew s. of Robert, confrere of the prior. Matthew laboured in Edward III's service with the said men-at-arms and archers in cos. Waterford, Tipperary, Cork and Limerick in the company of the Jcr , by the Jcr's order, until 20 Aug. [1377] 1 Ric. II, at the prior's expense. And because Edward III died on 21 June [1377], before the said 20 Aug., the T. and the barons of the Ex. of Ire. will not allow the wages to the prior for himself or the said men from 21 June, to the grave damage of the prior and the impoverishment of his estate. He seeks due reward in consideration of his expenses and labours so incurred without fees or wages after Edward III's death, so that his estate might be better maintained and he might comfort the K.'s lieges in Ire. in the future. The K. has granted £20 to the prior of his gift. ORDER to pay him that sum.

Geoffrey Vale pleads that in the time of the war by McMurgh and other Irish enemies and rebels of Leinster in 1 Ric. II [1377–8], who proposed a general conquest of those parts, James Butler, e. Ormond, Jcr, ordered Robert [Wikeford], abp Dublin, C., to go to Castledermot with all his force to resist the enemy. The C. proceeded to the town, but because he feared the destruction of the marches of Dublin by the said enemies, he could not stay there. He ordered Geoffrey to stay with as many men of his company as possible for the security of the town and resistance of the said enemy, promising wages or reward to Geoffrey for his labours. Geoffrey stayed in the town with 40 hobelars and 36 armed foot at his own expense during the war. He bought victuals for himself and his men worth 20m beyond his own goods, worth 40m. By divine grace, and by Geoffrey's stay in that town, the town and vicinity were better and more securely governed. He seeks due payment or adequate reward for his labours and expenses. The K. has granted him £20 of his gift. ORDER to pay him that sum.

In the K.'s parliament summoned and held at Castledermot on the next Monday after Ash Wednesday last, the venerable father, Alexander [Balscot], bp Ossory, the K.'s T. of Ire., was elected by advice of the K.'s council in Ire. to travel to Eng. to show and declare before the K. and his council of Eng. concerning the state of his land of Ire. and to seek and sue for aid and remedy from the K. in this part. Joan Dowysk has petitioned the Jcr and council that Edward III, late K. of Eng., grandfather of the present K., granted 10m to John Traharne at the latter's plea because a certain horse of his worth £10 was killed in the K.'s service by Edward III's Irish enemies on an expedition to Leys [Laois], and other horses of his worth 6m were seized at a town in co. Kildare named Grangia de Magaweny by the said enemies, who came to burn and destroy the town; and on that occasion, many enemies were killed and many others captured by John and other lieges of the K., among whom John captured a certain Dongh' Obrenan, whom he handed over to Edward III's court to be indicted. Although Edward III ordered the T. and chamberlains to pay John the said 10m, nevertheless they have not paid him until now. John owed various large sums when he died leaving his children of both sexes in Joan's custody. Joan cannot afford to pay the debts or sustain the children, and she seeks payment for the 10m to aid her in paying the debts and sustaining the children. Being satisfied by inspection of the rolls of chancery that the 10m were granted to John in the said manner, ORDER to pay Joan the said 10m as an aid unless the 10m were paid to John by Edward III.

The mayor, bailiff and commons of the city of Dublin have pleaded before the Jcr and council that, on the advice of the council, the Jcr ordered them to come to Leys [Laois] with all force possible on the occasion of an expedition against the Omorthes, Irish enemies then openly at war, promising them adequate reward for their expenses and labours in this matter. The mayor and commons went there with a large force at great expense and labour for 5 days, going and returning, and suffered a great loss of horses. They seek adequate reward for their expenses, labours and losses so that they will have the wherewithal to serve the K. in future. The K. has granted them £20 of his gift. ORDER to pay them the said £20.

James Boys clk has shown that in the time of Edward III, late K. of Eng., grandfather of the present K., on the advice of the then Jcr and council, he was appointed as clerk of the wages of men-at-arms, archers, horse and foot in Edward III's service in his Irish wars, and to levy and receive all debts in Munster of the K.; and James was continually occupied in the execution of this by order of the Jcr and council from the time of Edward III's death [21 June 1377] until 4 Oct. following, as news of Edward III's death had not then been received. In the execution of that office and the levying of debts, he was granted 40d a day, of which he pleads that little has been paid to him for that time. He seeks remedy. As the Jcr and council are satisfied as to the truth of the premises, the K. has granted James 10m of his gift. ORDER to pay him the said 10m.

Wishing lately to be informed as to the arrears of Robert Broun, formerly Edward III's constable of the castle of Carlow, of his annual fee of £20 while he holds the office for all the time he was constable, the K. ordered the T. and chamberlains of the Ex. to search the rolls and memoranda of the Ex. from the time of Edward III concerning the premises, returning their findings to the K. in the chancery of Ire. They returned that it is agreed that the arrears from 18 Aug. [1374] 48 Edw. It was ordained by the K.'s council in Eng. that 2000m should be delivered to Alexander [Balscot], bp Ossory, from the K.'s English treasury by certain indentures made between the K. and the bishop. The 2000m were to be taken with the bishop to Ire. so that —by the advice of the Jcr, C., T. and the earl of Kildare, and others of the K.'s council there—the people of that country [gentes patrie predicte] might be gathered as often as needs be in order to resist the K.'s enemies and rebels in that land and paid for the time that they are gathered with that sum, together with other sums and profits coming and pertaining to the K. in Ire. beyond any necessary charges which must be spent from those issues and profits in that land. And it was specified in those indentures that the bishop should pay nothing of the said sums without special order from the K. from time to time, viz. by the K.'s writs made to the bishop under the g.s. used in that land, on the advice and ordinance of said Jcr and others of the council, when such congregations occur. And the bishop was charged that he should by no means pay men-at-arms, hobelars and archers of that land unless such wages were customary there before this time, just as is contained in the indentures shown by him before the Jcr and council.

And the bishop pledged before the said Jcr, the keeper of the g.s., the earl of Kildare, and others of the council that he received only 1000m from the English treasury for the K.'s use, just as the earl of Kildare similarly testifies. And by virtue of certain letters under the K.'s p.s. addressed to the bishop (which were shown before the said Jcr, keeper of the g.s., the earl of Kildare and others of the Irish council), the bishop had to pay from that 1000m the wages of men-at-arms and archers in his company sent from Eng. to Ire., for their passage by sea to Ire.

And although the remainder of the 1000m ought to be spent according to the form of the indenture and not otherwise, because nothing was sent from the K. in Eng. for the salvation and governance of Ire. during the half year last past as specified in the indentures, and the retinue sent to Ire. to stay there for the salvation of the said land for that half year is now preparing to cross to Eng.—which, if it should come to pass, would greatly comfort the K.'s enemies and rebels, and the K.'s faithful lieges of his said land would be discomfited and destroyed, and truly his land might be easily reduced to nothing [facilius adnichilaretur]—the Jcr and council, considering the above, on the advice of the Jcr, the keeper of the g.s., the T., the earl of Kildare, and the rest of the council together with the better men of cos. Dublin, Kildare, Carlow and Kilkenny assembled at Castledermot on the present day [30 April 1379], agreed and ordained concerning the said retinue that 24 men-at-arms and 120 archers should be retained for the salvation and defence of the said land on the residue of the 1000m for a quarter year beginning on SS Phillip and James next [1 May 1379], each man-at-arms taking from the clerk of the wages 12d a day for his wages and 40s as reward for the quarter year, and each archer 6d a day for his wages. This was notwithstanding the ordinance that the said sum should be expended on the people of that country, as is said before, according to the accustomed wages paid in that land before this time.

And on account of the present necessity and the imminent dangers now threatening, which may easily come to pass if the sum is not spent, the K. ordered that sufficient warrants should be made to the bishop by writs of the K.'s chancery of Ire. commanding him to deliver the said wages and rewards to the clerk of the wages to be paid to the said 24 men-at-arms and 120 archers for the next quarter year; with proviso that, whatever should remain to the K. of the sum of 1000m after those wages and rewards have been paid, half should be spent on the northern side of the bridge of Leighlin and the other half on the southern side of the same bridge, on which the people of the country gather, just as is set out clearly in the said agreements and ordinances. The wages and rewards for the said 24 men-at-arms and 120 archers amount to £430 4s for the next quarter year. Wishing that this sum be paid in the said form, ORDER to deliver the £430 4s to Ralph Beltesford, K.'s clk, specially appointed to pay the said wages and rewards to the said men-at-arms and archers.

John Blakeburn pleads that on 13 Feb. [1379] last by letters patent, the K. appointed him together with brother William Tany, prior of the hospital of St John of Jerusalem in Ire., as a justice to inquire concerning trespasses and felonies in cos. Carlow, Kildare, Dublin and Louth against the peace of Edward III, late K. of Eng., and against the peace of the present K., and to hear and determine these trespasses at the K.'s suit and at that of any others, taking in that office 2s a day for each day of the session. John held the said session in those counties for 80 days and more with the prior, and seeks satisfaction of the daily sum, which amounts to £8 for the 80 days. Patrick de la Freigne, seneschal of the liberty of Kilkenny, has shown the K. by petition displayed before the Jcr and council at Drogheda on 11 May [1379] 2 Ric. II, that in the time of [Edward III], late K. of Eng., a writ was issued from the Ex. for him to account for the issues of his bailiwick when he was at war in Kilkenny, for which he was fined 100s; and another writ [was issued] in similar manner, [for which he was] fined 100s; and another, for which he was fined £10; and another, for which he was fined 100s; and another, for which he was fined £20; and for all of that time he was engaged as above. To the T. and chamberlains of the Ex.

Hugh Rochefort, seneschal and receiver of the K.'s demesne in co. Wexford, has pleaded that in the time of Edward III, late K. of Eng., he pleaded by petition to the then Jcr and council for reward and expenses in those offices for one whole year in the time of Edward III. He was granted £4; and although Edward III ordered the then T. and chamberlains to pay Hugh the said £4, nevertheless they do not intend to pay him without the K.'s order because Edward III died before Hugh had satisfaction of the £4 or any part of it. He seeks remedy. ORDER that if Hugo has not yet been satisfied of the said £4, they are to pay him the said sum. And by the same petition, Hugh showed that he served in those offices from Edward III's death [21 June 1377] until now without reward, suffering great expenses and labours, and he will have to account for that office from the time of Edward III and that of the present K., and charge his expenses in the rendering of that account. The K. has granted him another £4 to have of his gift for his labours and expenses in that office, and which he will sustain in making his account. ORDER to pay him this £4.

Wishing lately to be informed concerning the arrears of Robert Preston, formerly chief justice of Edward III, late K. of Eng., grandfather of the present K., of his annual fee of £40. viz. for all the time he was justice, the K. ordered T. and chamberlains of the Ex. to search the rolls and memoranda concerning the premises, returning their findings to the K. in his chancery of Ire. They returned that it is agreed that the arrears of Robert of the said fee from 9 April [1376] 50 Edw. III until 9 Jan. [1377] following, viz. for three quarters of a year, amount to £6 6s 8d, and the arrears of the same fee from the said 9 Jan. [1377] until 20 June [1377] 51 Edw. III, viz. a quarter year and 72 days, amount to £17 13 6d. Wishing that satisfaction be made to Robert of the said sums, ORDER to pay him the said £6 6s 8d and £17 13 6d.

On 20 Oct. [1378] 2 Ric. II, the K. appointed Thomas Mareward and John fitz Rery justices to keep ordinances and statutes relating to workmen and servants in co. Dublin and to inquire concerning all masters, mariners, ships, boats [etc.] attempting contrary to statutes and ordinances made; and they were to hear and determine the same, for which they are to have one third of all fines. ORDER, because William fitz William did not allow them the said one third in his account, to cause due allowance to be made.
