Explanation

advowson

The right of patronage or presentation to a church benefice.

allocate, writ of

A writ authorizing allowance to be made by the officers of the Ex. of a specified amount: often this amount is to be off-set against the debts owed to the K. by the beneficiary.

alterage

A form of affinity proscribed in late medieval Ireland between the Irish and the English, whereby a man stood sponsor for a child at baptism; (also) gossipred.

assize

Technical term for legal proceedings or various kinds. See mort d’ancestor, novel disseisin.

avener [Lat. avarius]

provider of oats, esp. for the household of the K. or his chief governor

avoirdupois

Miscellaneous merchandise sold by weight.

bonnaght [Ir. buannacht]

The billeting of mercenaries or servants.

cask

See tun.

certiorari, writ of

Letters close issued by the K. to his officers commanding them to supply information to him concerning a specified matter, normally by searching the records.

chattels

Property, goods, money: as opposed to real property (land).

dicker [Lat. dacra]

A measure of 10 hides.

dower

Portion (one third) of a deceased husband’s estate which the law allows to his widow for her life.

escheat

The reversion of land to the lord of the fee to the crown on failure of heirs of the owner or on his outlawry.

extent

A survey and valuation of property, esp. one made by royal inquisition.

falding [Ir. fallaing]

A kind of coarse woollen cloth produced in Ireland; the mantle or cloak made from the same.

fee-farm
 

A fixed annual rent payable to the K. by chartered boroughs.

fotmel [Lat. fotmellum]

A measure of lead.

engrossment

Technical term: the action of writing out, for instance patent letters and charters; (also) the documents thus written out.

enrolment

Technical term: the action of recording in the records of the K., esp. the registering of a deed, memorandum, recognizance; (also) the specific item or record thus enrolled.

hanaper

A repository for the keeping of money. The ‘clerk of the hanaper in chancery’ was the chancery official responsible for the receipt of fines for the issue, engrossment and ensealing of writs, patents and charters issued by the chancery.

herberger [Lat. herbergerius, hospitator]

One sent on before to purvey lodgings for an army, a royal train (OED).

galangal [AN galyngale]

The aromatic rhizome of certain Asian plants of the genera Alpinia and Kaempferia, of the ginger family, used in cookery and herbal medicine; (also) any of these plants (OED).

generosus [Lat.]

Term designating social status: translated as ‘gentleman’.

king's widow [Lat. vidua regis]

The widow of a tenant in chief: so called because whe was not allowed to marry a second time without royal licence.

knights’ fees

Units of assessment of estates in land. Originally a single knight’s fee was the amount of land for which the military service of one knight (=knight service) was required by the crown. ‘Fee’ derives from the Latin feudum, which in other contexts translated as ‘fief’. In practice the descent of landed estates meant that many knights’ fees came to be subdivided and, in the later Middle Ages, personal service was frequently commuted to money payments (=scutage).

liberate, writ of

A chancery writ issued to the treasurer and chamberlains of the Ex. authorizing them to make payment of a specified amount, often the annual fees, wages and rewards of the K.’s officers.

linch [Lat. lincia]

A measure of tin.

livery

The delivery of seisin, or possession, of an estate hitherto held in the K.’s hand, for instance when a minor reaches the age of majority.

mainprize

Legal term: the action of undertaking to stand surety (=‘mainpernor’) for another person; the action of making oneself legally responsible for the fulfilment of a contract or undertaking by another person (OED).

mass [Lat. messa]

A standard measure of metal.

messuage

A portion of land occupied, or intended to be occupied, as the site for a dwelling house; (also) a dwelling house together with outbuildings and the adjacent land assigned to its use (OED).

mort d’ancestor, assize of [Lat. assisa mortis antecessoris]

A legal process to recover land of which the plaintiff’s ancestor (father, mother, uncle, aunt, brother sister, nephew or niece) died seised (=in possession), possession of which was since taken by another person.

nolumus, clause of [Lat. cum clausula nolumus]

A standard clause inserted especially in letters of protection by which pleas and suits are delayed for a specified period of time.

novel disseisin, assize of [Lat. assisa nove disseisine]

A legal process to recover land from which the plaintiff claims to have been dispossessed (=disseised).

pensa See wey.
piece [L. pecia] A standard quantity of merchandise.
pendent seal Seal hanging from engrossed letters patent attached to a tongue or tag of parchment.
perpresture An illegal encroachment upon royal property.
plica A fold along the foot of engrossed letters patent and charters to create a double thickness of parchment, used for attaching the ‘great seal pendent’ to the letters. An incision was made in the plica and through which a tag of parchment was attached. A wax impression of a seal was then affixed to the tag.
protection An act of grace by the K., granted by chancery letters, by which the recipient is to be free from suits at law for a specified term; granted especially to persons crossing overseas or otherwise out of reach of the courts in the K.’s service.
quare impedit, writ of An action brought to recover the advowson of a benefice, brought by the patron against the bishop or other person hindering the presentation.
scutage The commutation of personal military service to the crown for a money payment. Normally called ‘royal service’ in Ireland.
seisin Formal legal possession of land.
sendal [Lat. cendallum; ME cendal] A thin rich silken material (OED).
stallage [Lat. stallagium, estallagium] Payment for a market stall.
tun [Latdolium] A large cask or barrel, esp. of wine.
valettus A term designating social status: translated ‘yeoman’.
Vidua Regis [Lat.] See King's widow.
volumus, clause of [Lat. cum clausula volumus] A standard clause inserted esp. in letters of protection by which pleas and suits are delayed for a specified period of time. In full the clause runs: volumus quod interim sit quietus de omnibus placitis et querelis (=we wish that meanwhile he be quit of all pleas and plaints).
waif A piece of property which is found ownerless and which, if unclaimed within a fixed period after due notice given, falls to the lord.
waivery [AN weiverie] The technical term for proceedings of outlawry in the case of women.
wey [Lat. pensa, peisa, pisa] A standard of dry-goods weight.
worsted [ME wyrstede] A woollen fabric or stuff made from well-twisted yarn spun of long-staple wool combed to lay the fibres parallel (OED).
writ [Lat. brevis] Letters close containing commands by the K. to certain specified persons, esp. royal officers. Returnable writs, which were not normally enrolled in the chancery rolls, were to be returned by the officer to chancery with details of the actions taken by the officer in response to the contents. See also allocate, certiorari, liberate.

Ralph Meiler has shown that on 1 June [1341] 15 Edw. III he made a recognizance to pay the K. £500, on the condition that if on or before 17 June [1341] 15 Edw. III he delivered to the deputy Jcr Henry s. of Onolan, hostage for Onolan, an Irishman then enemy and rebel of the K., delivered to Ralph to remain in his custody, that then the recognisance would be cancelled. Ralph delivered the hostage to Dublin before 17 June and handed him over to the deputy Jcr, de quo tanquam de obside forsfacto Ex. et consuetudo extiterant facte, asta Robert Askeby, then C. of Ire., caused the recognisance to be enrolled simply in the chancery rolls, by entry of which enrollment the £500 run in the estreats of the chancery delivered into the Ex. and are demanded of Ralph. It was found by inspection of the rolls that this was so. ORDER to remove anything to do with the recognizance from the rolls and exonerate Ralph.

The tenants of the manor of Saggart have shown that Adam Talbot, sheriff of Dublin, in his account at the Ex., is charged with 100s of an immense sum of money owed by the community of the manor for arrears of farm from the time of the war of Art McMurgh, more that 40 years ago, and of which they have not yet paid anything. They have asked that the K. would give consideration to the poverty of them, the K.'s tenants, because they can scarcely pay their annual rent and that they have paid nothing of the arrears because during that time the lands and tenements of the manor were frista et vasta by reason of the war, and would exonerate the sheriff. ORDER to exonerate the sheriff and charge the tenants with the sum as they had previously been charged.

Peter Okebourn has shown that, on 29 March [1335] 9 Edw. III, the lands and tenements in Ire. of Thomas Furnyvale and Joan his wife were taken into the K.'s hand by John Morice, then escheator, and afterwards were committed to Peter at the extent by clerks of the Ex. Afterwards, on 10 July [1336] 10 Edw. III, the K. by writ from Eng. ordered the escheator to restore them and the issues in the meantime to Thomas and the escheator has accounted for them for this period, but the T. and barons charge him with the issues and with rendering an account. ORDER to examine the escheator's rolls and other membranes of the Ex., and, if true, to exonerate Peter.

On 20 July [1342] last, because he had proven his age in the Irish chancery, the K. restored, by writ to the escheator of Ire., to Maurice son of Thomas s. of John, late earl Kildare, brother and heir of Richard son Thomas s.of John, the lands and tenements of his inheritance of the liberty of co. Kildare and other things mentioned in the writ that were in the K.'s hand. On 22 July next by another writ the K. ordered the T. and barons to admit Maurice's seneschal at the Ex. On 8 Aug. following advertenies that the writ to the excheator ex sumpcione curie nostre emanasse eo quod redditio illa indebita extitit, it was revoked and escheator ordered to reseize the lands [etc.] The K. has learned by advice of the council that the writ of 10 July and the enrollment of the seneschal's appointment and oath should be annulled. ORDER to cancel the writ and its enrollment, oath and commission.

Brother John Larcher, prior of the hospital of St John of Jerusalem in Ire., has shown by petition before deputy justiciar and council that on 20 March [1336] 10 Edw. III the K. granted Alexander [Bicknor] abp Dublin the custody of the lands and tenements which belonged to Henry Cogan in Ire. until the majority of the heir, without paying anything. The archbishop was seised and received issues from that date until now. On 24 April in the same year the K. granted Roger Outlaw, former prior of the hospital, custody of all lands and tenements of Peter Cogan until majority of heir rendering extent. He and his successors never interfered or received any issues, the present prior is being charged to account for the extent. ORDER to examine commission of letters patent and, if true, exonerate the prior.

Kildare, father of Maurice, paying the extent, taking annually for the maintenance of Maurice as much as John Darcy did at the time he had the custody and John in his account had allowance for this of 40m p.a. On 24 Jan. by other letters patent the K. granted to Maurice [etc.] £40 p.a. for maintenance, but the T. and barons have allowed them only 40m. The K. granted Walter le Warde the office of serjeant of all of Meath both inside and outside the liberties, which John Bacon held of the K. and which was taken into the K.'s hand by John's forfeiture, as is more fully contained in the English letters patent. The Friars Minor of Dublin have shown that Bartholomew Crok, late citizen of Dublin, in his last will bequeathed 20m to remain in the custody of William Douce, lately a fellow citizen of the city, to fund to the brothers out of the profits and issues of the 20m bread, wine and wax for all masses to be celebrated in the house of the friars at Dublin in perpetuity. They have asked by petition to the deputy Jcr and council that the 20m after the death of William were taken into the K.'s hand among his own goods and chattels for debts owed by him to the K., so that the friars can find bread, wine and wax. ORDER to take inquest in presence of executors of William and, if found to be true, remove K.'s hand from the 20m.

The K. has been informed on behalf of Robert Clifford, one of the heirs of Richard Clare, that Richard lately owed the K. £500 0s 4d for arrears of his account of the time he was sheriff of Cork, for which Robert's lands and tenements in Any in co. Limerick, which descended to him by hereditory right after the death of Richard, by a partition made between Robert and Richard's other heirs, were taken into the K.'s hand, totally omitting and exonerating the lands and tenements of the other co-heirs, Bartholomew Badlesmere and his heirs in the land of peace viz. in co. Cork, so that £31 was levied from Robert's lands in Any. Robert has asked for remedy. ORDER to remove the K.'s hand from his land in Any by writ of Ex. to sheriff of Cork, cause £31 to be levied from Bartholomew's lands in co. Cork and the remainder to be charged in common on all Richard's heirs and their lands in proportion to their portions as is right.
