Explanation

advowson

The right of patronage or presentation to a church benefice.

allocate, writ of

A writ authorizing allowance to be made by the officers of the Ex. of a specified amount: often this amount is to be off-set against the debts owed to the K. by the beneficiary.

alterage

A form of affinity proscribed in late medieval Ireland between the Irish and the English, whereby a man stood sponsor for a child at baptism; (also) gossipred.

assize

Technical term for legal proceedings or various kinds. See mort d’ancestor, novel disseisin.

avener [Lat. avarius]

provider of oats, esp. for the household of the K. or his chief governor

avoirdupois

Miscellaneous merchandise sold by weight.

bonnaght [Ir. buannacht]

The billeting of mercenaries or servants.

cask

See tun.

certiorari, writ of

Letters close issued by the K. to his officers commanding them to supply information to him concerning a specified matter, normally by searching the records.

chattels

Property, goods, money: as opposed to real property (land).

dicker [Lat. dacra]

A measure of 10 hides.

dower

Portion (one third) of a deceased husband’s estate which the law allows to his widow for her life.

escheat

The reversion of land to the lord of the fee to the crown on failure of heirs of the owner or on his outlawry.

extent

A survey and valuation of property, esp. one made by royal inquisition.

falding [Ir. fallaing]

A kind of coarse woollen cloth produced in Ireland; the mantle or cloak made from the same.

fee-farm
 

A fixed annual rent payable to the K. by chartered boroughs.

fotmel [Lat. fotmellum]

A measure of lead.

engrossment

Technical term: the action of writing out, for instance patent letters and charters; (also) the documents thus written out.

enrolment

Technical term: the action of recording in the records of the K., esp. the registering of a deed, memorandum, recognizance; (also) the specific item or record thus enrolled.

hanaper

A repository for the keeping of money. The ‘clerk of the hanaper in chancery’ was the chancery official responsible for the receipt of fines for the issue, engrossment and ensealing of writs, patents and charters issued by the chancery.

herberger [Lat. herbergerius, hospitator]

One sent on before to purvey lodgings for an army, a royal train (OED).

galangal [AN galyngale]

The aromatic rhizome of certain Asian plants of the genera Alpinia and Kaempferia, of the ginger family, used in cookery and herbal medicine; (also) any of these plants (OED).

generosus [Lat.]

Term designating social status: translated as ‘gentleman’.

king's widow [Lat. vidua regis]

The widow of a tenant in chief: so called because whe was not allowed to marry a second time without royal licence.

knights’ fees

Units of assessment of estates in land. Originally a single knight’s fee was the amount of land for which the military service of one knight (=knight service) was required by the crown. ‘Fee’ derives from the Latin feudum, which in other contexts translated as ‘fief’. In practice the descent of landed estates meant that many knights’ fees came to be subdivided and, in the later Middle Ages, personal service was frequently commuted to money payments (=scutage).

liberate, writ of

A chancery writ issued to the treasurer and chamberlains of the Ex. authorizing them to make payment of a specified amount, often the annual fees, wages and rewards of the K.’s officers.

linch [Lat. lincia]

A measure of tin.

livery

The delivery of seisin, or possession, of an estate hitherto held in the K.’s hand, for instance when a minor reaches the age of majority.

mainprize

Legal term: the action of undertaking to stand surety (=‘mainpernor’) for another person; the action of making oneself legally responsible for the fulfilment of a contract or undertaking by another person (OED).

mass [Lat. messa]

A standard measure of metal.

messuage

A portion of land occupied, or intended to be occupied, as the site for a dwelling house; (also) a dwelling house together with outbuildings and the adjacent land assigned to its use (OED).

mort d’ancestor, assize of [Lat. assisa mortis antecessoris]

A legal process to recover land of which the plaintiff’s ancestor (father, mother, uncle, aunt, brother sister, nephew or niece) died seised (=in possession), possession of which was since taken by another person.

nolumus, clause of [Lat. cum clausula nolumus]

A standard clause inserted especially in letters of protection by which pleas and suits are delayed for a specified period of time.

novel disseisin, assize of [Lat. assisa nove disseisine]

A legal process to recover land from which the plaintiff claims to have been dispossessed (=disseised).

pensa See wey.
piece [L. pecia] A standard quantity of merchandise.
pendent seal Seal hanging from engrossed letters patent attached to a tongue or tag of parchment.
perpresture An illegal encroachment upon royal property.
plica A fold along the foot of engrossed letters patent and charters to create a double thickness of parchment, used for attaching the ‘great seal pendent’ to the letters. An incision was made in the plica and through which a tag of parchment was attached. A wax impression of a seal was then affixed to the tag.
protection An act of grace by the K., granted by chancery letters, by which the recipient is to be free from suits at law for a specified term; granted especially to persons crossing overseas or otherwise out of reach of the courts in the K.’s service.
quare impedit, writ of An action brought to recover the advowson of a benefice, brought by the patron against the bishop or other person hindering the presentation.
scutage The commutation of personal military service to the crown for a money payment. Normally called ‘royal service’ in Ireland.
seisin Formal legal possession of land.
sendal [Lat. cendallum; ME cendal] A thin rich silken material (OED).
stallage [Lat. stallagium, estallagium] Payment for a market stall.
tun [Latdolium] A large cask or barrel, esp. of wine.
valettus A term designating social status: translated ‘yeoman’.
Vidua Regis [Lat.] See King's widow.
volumus, clause of [Lat. cum clausula volumus] A standard clause inserted esp. in letters of protection by which pleas and suits are delayed for a specified period of time. In full the clause runs: volumus quod interim sit quietus de omnibus placitis et querelis (=we wish that meanwhile he be quit of all pleas and plaints).
waif A piece of property which is found ownerless and which, if unclaimed within a fixed period after due notice given, falls to the lord.
waivery [AN weiverie] The technical term for proceedings of outlawry in the case of women.
wey [Lat. pensa, peisa, pisa] A standard of dry-goods weight.
worsted [ME wyrstede] A woollen fabric or stuff made from well-twisted yarn spun of long-staple wool combed to lay the fibres parallel (OED).
writ [Lat. brevis] Letters close containing commands by the K. to certain specified persons, esp. royal officers. Returnable writs, which were not normally enrolled in the chancery rolls, were to be returned by the officer to chancery with details of the actions taken by the officer in response to the contents. See also allocate, certiorari, liberate.

Thomas Everdoun clk pleads that from the time of the death of Edward III, the late K., grandfather of the present K. [21 June 1377], he laboured in the company of James Butler, e. Ormond, Jcr, in cos. Cork, Limerick, Tipperary and Kilkenny; and also as clerk of the C. of Ire., doing all things pertaining to that office until Michaelmas last [1377], and afterwards in cos. Carlow, Kildare and Dublin, until the arrival of R[obert Wikeford], abp Dublin, C. of Ire., without receiving anything from the present K., or his grandfather, for his expenses and labours. He seeks remedy. On the advice of the Jcr and council, the K. has granted him 5m of his gift. ORDER to pay Thomas that sum.

Wishing lately to be informed concerning the arrears of John Keppok, formerly justice at pleas following the Jcr in Ire. of Edward III, the late K., grandfather of the present K., of his annual fee of £40 while he held that office, and concerning 40d a day that he takes while holding that office, the K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. for that time returning their findings to the K. in the chancery of Ire.

They returned that it is agreed that the arrears of John from 22 March [1373] 47 Edw. III until 22 June [1374] 48 Edw. III, viz. 1¼ years, amount to £13 10s ¾d; and his arrears from the said 22 June [1374] until 22 Sept. [1375] 49 Edw. III, viz. 1¼ years, amount to £20 10s 2d; and his arrears from that 22 Sept. until 20 June [1377] 51 Edw. III, viz. 1¾ years except two days, amount to £69 15s 7½d. His arrears of the 40d daily from 15 Nov. [1373] 47 Edw. III until 31 Oct. [1375] 49 Edw. III, viz. 1¾ years and 77 days, amount to £17 8s 7d; and his arrears of the same from […] Nov. [1375] 49 Edw. III until 20 June [1377] 51 Edw. III […] amount to £99 […].

Wishing lately to be informed concerning the arrears of Robert Sutton, formerly keeper of the chancery rolls of Edward III, the late K., grandfather of the present K., of his fee of £10 p.a., the K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. from that time, returning their findings to the K. in the chancery of Ire.

They returned that it is agreed that Robert's arrears from 4 Feb. [1375] 49 Edw. III until 4 Aug. [1376] 50 Edw. III, viz. 1½ years, amount to 20s; and his arrears from 4 Feb. [1377] 51 Edw. III until 20 June following, viz. a quarter year and 44 days, amount to 74s ¾d.

Wishing that satisfaction be made to Robert of the said sums, ORDER to pay him those 20s and 74s ¾d.

Ormond, formerly constable Dublin castle of Edward III, the late K., of his annual fee of £18 5s, viz. for all the time he was Edward III's constable, the K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. for the time of Edward III concerning the premises, returning their findings to the K. in the chancery of Ire.

They returned that it is agreed that the arrears of the earl's fee from 2 April [1372] 46 Edw. III until 2 Jan. [1374] 48 Edw. III, viz. 2¾ years, amount to £13 5s 5d; and that his arrears from the said 2 Jan. until 20 June [1377] 51 Edw. III, viz. 2¼ years and 79 days, amount to £45 3d. Wishing that the earl be satisfied of the said debts, ORDER to pay him the said sums.

On the advice of the K.'s council of Ire., the K. has granted £20 to the same archbishop, the K.'s C., to have of his gift by name of reward for the said reasons. ORDER to pay him the said £20.1

The K.'s beloved John Beek, citizen of the K.'s city of Dublin, has shown by his petition displayed to the Jcr and others of the K.'s council in Ire. in his parliament lately summoned and held at Castledermot on the next Monday after Ash Wednesday last [8 March 1378] that one John Scrope, in the time when he was clerk of the wages and works in Ire. of the lord Edward [III], late K. of Eng., grandfather of the present K., took various goods and chattels from the said John Beek worth 71s for the late K.'s use. And although John Beek sued by his petition displayed to William Windsor, then governor and keeper of Ire., and others of the late K.'s council, for payment of the said 71s, he has been unable to have payment of those 71s and still does not have it. He seeks payment of the said 71s.

By a record concerning this sent from the Ex. to the chancery by the K.'s order it appears that John Beek delivered various goods and chattels to the sum of 71s to the said John Scrope for the use of Edward III, as aforesaid. Wishing that right be done in this part both for himself and for John Beek, the K. ordered the T. and barons of his Ex. that, having examined the rolls and memoranda of the Ex. both from the time of Edward III and the present K., if it appeared that John Beek had any allowance of the 71s then they should inform the K. of their findings in chancery. The T. and barons returned that they could not find that the said John Beek had any such allowance of the 71s. Because the K. wishes that John Beek be satisfied of those 71s, ORDER to pay him that sum from the K.'s treasury.

Murghe Obreen, having assembled a great force [magna potencia] of Irishmen, the K.'s enemies and rebels of Munster, lately came to Leinster in aid of the K.'s enemies there, proposing to wage war on the K.'s lieges in Leinster and do his utmost to destroy those parts. The Jcr and council, together with the prelates, magnates, peers and commons assembled in the K.'s parliament summoned and held at Castledermot on the next Monday after Ash Wednesday last [8 March 1378], perceiving the damage and evil that Murghe might easily do with his said force in Leinster if he were permitted to remain there without resistance, ordained and agreed among themselves in the K.'s parliament that Murghe should have 100m so that he would withdraw himself from Leinster with his force, and that thenceforth he would never commit, or cause to be committed, any further evils there. [And the said Murghe undertook to do the same by swearing on the holy gospels before the said council.] And the clergy and commons of cos. Dublin, Kildare, Kilkenny and Wexford agreed to pay the said 100m, with the exception of 9m, to be levied from them for the use of Murghe. And because Murghe did not wish or intend withdraw from Leinster with his company unless he was satisfied immediately and entirely of the said 100s, on the advice of the Jcr and council, it was agreed that the 9m should be paid to Murghe as in the agreement enrolled in the rolls of the chancery of Ire.1 ORDER to pay Murghe the said 9m.

Alexander [Balscot], bp Ossory, has pleaded by petition before the Jcr and council that he held the office of T. in Ire. at the time that Edward III, the late K., died [21 June 1377], and he has held all things pertaining to that office in his custody from the death of the present K.'s grandfather [Edward III] until now; and a certain clerk of his during that time remained at Carlow in the custody of the premises, having reward from the bishop. And although the bishop was not one of the K.'s officers, he was in his service in the Jcr's company at Waterford, Kells and in various other places from the time of the death of the late K., and on one occasion he went to Wexford at his own expense with Patrick de la Freigne to treat with the enemy there, and another time to Castledermot to treat with the K.'s council gathered there. He seeks reward for his expenses and labours. As the Jcr has testified to the truth of the premises, the K. grants the bishop £40 for himself and the clerk for the above reasons. Tirrelaghe Obreen has shown the K. by his petition displayed to the Jcr and council in Ire. in his parliament summoned and held at Castledermot on the next Monday after Ash Wednesday last [8 March 1378] that when William Windsor was the K.'s governor and keeper of Ire., viz. in the time of the lord Edward III, late K. of Eng., grandfather of the present K., he was constituted by royal power chieftain of his lineage, viz. Obreen of Thomond. And on account of his name and the charge he accepted in this part, Tirrelaghe waged a most vigorous war against the former [antiquum] Obreen, then the enemy and rebel of Edward III, who was seeking to destroy the faithful lieges of the K. and the parts of Munster with his power, incurring grave expenses and labours because of the premises until he was expelled from his country [patria] by the power of the former Obreen for lack of aid from Edward III as had been promised to him in this part. And now Tirrelaghe, not having the wherewithal to live, seeks remuneration from the K. in consideration of the premises. The prior and convent of the Carmelite friars of the house of the Blessed Mary of Leighlin have shown that the Irish enemies and rebels of the neighbouring part threaten daily to destroy that house unless remedy is made; and the prior and convent are impoverished by the maintenance and safe custody of that house against these enemies, sustaining damage and loss daily. They are powerless without aid from the K. to remain there and guard the house against the said enemies. They plead that the alms granted to them annually by Edward III, the late K., for the maintenance and safe custody of the house, of which a large sum is in arrears, should be provided to them. In consideration of the poverty of the prior and convent, and the succour they give to the K.'s faithful people, the K. grants them £10 of his alms in relief of themselves and the house. Robert de la Freigne kt and John Lumbard have shown that they were commissioned in the time of Edward III, the late K., as justices to inquire concerning all trespasses and felonies and various other matters in Leinster and Munster, and to hear and determine the same. Afterwards they were commissioned as justices of the present K. in the said part by the K.'s letters patent, by virtue of which they laboured in those parts in the execution of the premises at their own expense with receiving reward from the K., bringing great profit to the K. in those parts by delivering well-known malefactors and robbers according to the law, and thereby incurring the ill-will [odium] and hatred of malefactors and robbers so that Robert and John, labouring in the present K.'s service and that of Edward III, had to employ, at their own expense, persons to guard their manors and vills by night to protect them from danger because of that ill-will. They seek reward. The K. grants £10 to Robert and 100s to John of his gift in recompense for their expenses and labours. ORDER to pay them those sums.

Wishing lately to be informed concerning the arrears of Thomas Everdon, formerly one of the clerks of the chancery in Ire. of Edward III, the late K., grandfather of the present K., of his annual fee of £10 while he held that office, the K. ordered the T. and chamberlains of the Ex. to search the rolls and memoranda of the Ex. concerning the premises, returning their findings to the K. in chancery. They returned that it is agreed that the arrears from 20 March [1377] 51 Edw. III until 20 June following, viz. a quarter year, amount to 50s. Thomas Everdon clk has shown that when he was a clerk of the chancery of Edward III, the late K., three tallies of 100s—viz. one of 66s 8d from Easter 49 Edw. III [1375], another of 13s 4d in the same term and month, and a third of 20s in Trinity term that year—were levied in the receipt of the Ex. by brother Thomas Scurlag, abbot of St Thomas the Martyr near Dublin, then deputy T., for the said Thomas [Everdon] in part-payment of his annual fee while in that office. The tallies were delivered to Thomas Holhurst, formerly Edward III's collector of the great new custom in Dublin. The said clerk received none of the money contained in these tallies from Thomas Holhurst before the death of Edward III, nor could he do so afterwards by reason of the K.'s death. He seeks payment or assignment of debts. ORDER to receive the said tallies from Thomas Everdon and destroy them so that he obtains no benefit from them; and they are to cause due assignment or payment to be made to the said Thomas of that 100s.

John [Young], bp Leighlin, has shown the K. by his petition that he stayed in the marches of co. Carlow because of the K.'s Irish enemies and rebels for 13 years at his own great expense and labour, and he constructed various fortifications in the said marches to resist the said enemy for the aid and protection of the K.'s lieges there at his own expense without aid from the K., retaining various people there at his expense for those reasons; and he placed under interdict and excommunicated the said enemies and rebels because of their rebellion against the K.'s lieges. For this reason the enemies burnt the bishop's tenants, lands and tenements, churches and towns in those parts, and they despoiled his oxen and other goods and chattels there, so that he has not a single one there now, whereby he cannot resist the enemy without aid, nor can he support himself nor remain there. He seeks reward or compensation for the premises, or relief and maintenances of his state. The K. has granted him 20m of his gift for the above reasons. ORDER to pay him that sum.

MEMORANDUM that on 26 June [1377],1 Art' McMurgh, chieftain of his lineage, was admitted to the K.'s peace and swearing upon the holy gospels he promised to conduct himself well towards the K. and his faithful people, and to assist in the defence and safety of Leinster against any enemies and rebels when required; and also to protect the K.'s highways of cos. Carlow and Kilkenny. Whereupon the said Art' sought to have 80m p.a. from the K., just as Edward III, the late K., used to pay to his ancestors. The Jcr and council were unwilling to consent to this as a fee because he had forfeited the same to the K.; but they agreed that as a reward for good services to be performed, he should receive the same from the date of these presents during pleasure, receiving 10m in the middle and 10m at the end of each quarter.2

Murghe Obreen, having assembled a great force [magna potencia] of Irishmen, the K.'s enemies and rebels of Munster, lately came to Leinster in aid of the K.'s enemies there, proposing to wage war on the K.'s lieges in Leinster and do his utmost to destroy those parts. The Jcr and council, together with the prelates, magnates, peers and commons assembled in the K.'s parliament summoned and held at Castledermot on the next Monday after Ash Wednesday last [8 March 1378], perceiving the damage and evil that Murghe might easily do with his said force in Leinster if he were permitted to remain there without resistance, ordained and agreed among themselves in the K.'s parliament that Murghe should have 100m so that he would withdraw himself from Leinster with his force, and that thenceforth he would never commit, or cause to be committed, any further evils there. [And the said Murghe undertook to do the same by swearing on the holy gospels before the said council.] And the clergy and commons of cos. Dublin, Kildare, Kilkenny and Wexford agreed to pay the said 100m, with the exception of 9m, to be levied from them for the use of Murghe. And because Murghe did not wish or intend withdraw from Leinster with his company unless he was satisfied immediately and entirely of the said 100s, on the advice of the Jcr and council, it was agreed that the 9m should be paid to Murghe as in the agreement enrolled in the rolls of the chancery of Ire. And the K. ordered the T. and chamberlains by writ to pay Murghe those 9m from his treasury.1 Furthermore, because those 91m granted separately by the clergy and commons to the said Murghe in part-payment of the 100m could not be levied very speedily, the K. appointed commissioners to levy and collect the said 91m from the said clergy and commons according to their grant and to answer to the K. therefor at his Ex., just as appears by inspection of the rolls of the chancery of Ire. Upon this and because Murghe did not wish to grant a day or conditions [diem aut inducias] concerning the said 100m, it was agreed similarly by the Jcr and council, and the T. was charged and enjoined to cause money, horses, armour and other necessary items to be purveyed wherever he might best do so, to the value of 100m, and to satisfy Murghe therefor without delay. And the T., on account of the agreement, enjoinder and charge paid the said 100m in the following manner, viz. 9m from the K.'s treasury; 16m by the hands of the prior of the hospital of St John of Jerusalem in Ire., by the hands of William fitz William one horse for 20m; and by the hands of brother John fitz Gerald, master of Kilclogan, one horse and one hauberk [loricam] for 25m; and by the hands of Robert Lughteburghe one horse for 20m; and by the hands of John More one lectum [?horse-litter] for 30s; and by the hands of Patrick de la Freigne and Robert de la Freigne, knights, 7m 10s. And the T. found pledges for the sums that the said persons undertook to pay, and he was obliged to the same persons for the payment of those sums to be made to them. It was agreed by the Jcr and council that those 91m should be paid by the T. and chamberlains from his treasury. ORDER to pay the said persons the said sums owed to them from the K.'s treasury.

William Balymore pleads that when he was in the service of Edward III, the late K., when the town of Carlow was last burned by the Obrynnes, the K.'s enemies and rebels, he was captured by the said enemies and lost horses and armour worth 20m, and was imprisoned for three quarters of a year and more until a fine of 165m was paid for his delivery. In order to pay that sum, William gave his lands and tenements as security, and sold all his goods and chattels; and still he owes various sums to certain persons for the part-payment of the said fine, so that he lacks the wherewithal to live. The K. has granted him £10 of his gift for the said reasons. ORDER to pay William the said £10.

Geoffrey Vale, the K.'s sheriff of Carlow, has pleaded to the K. that he owes £40 to McMurghe, chieftain of his lineage, for the slaying of Donaldus Kevenaghe, formerly called McMurghe, killed by the said Geoffrey. Geoffrey does not have the wherewithal to pay the said £40 from his own goods to the present McMurghe. Geoffrey pleads that, in consideration of the grave damages and great persecution he sustained on this account, the K. might deign to grant him a suitable reward in aid of paying the said £40. Wishing graciously to help Geoffrey in this part, the K. has granted him 20m to have of his gift as a reward for the said causes. ORDER to pay Geoffrey those 20m.

The K.'s clerk, Richard Walsh, parson of the church of Carlow, has shown that after the death of Edward III, the late K., grandfather of the present K., he stayed at the town of Carlow with various men in his company for the safety of the town against the malice of McMurghe, chieftain of his lineage, and other Irish enemies then openly at war from 20 June [1377] last until the quindene of Hilary [1378] following in the maintenance and comfort of the lieges of that town who proposed to leave that town if he did not remain; and he suffered great expenses as a result. And when the town was burned all his houses were burned by the enemy, and his goods and chattels despoiled. He seeks reward for his expenses and losses. The K. has granted him 5m of his gift. The K.'s beloved John More, formerly usher of the Ex. in Ire. of Edward III, the late K. of Eng., grandfather of the present K., has pleaded that in part-payment of various sums of money paid by John for various minor necessities lately bought by him for the use of Edward III, various tallies were assigned to John at the receipt of the Ex. The following tallies were levied in the receipt of the Ex.: two tallies of 10m from Walter Lenfaunt kt, then seneschal of the liberty of Tipperary, in Michaelmas term 48 Edw. III [1374] in the time of John Colton, dean of Dublin, then T. in Ire. of Edward III; and one tally of £8 from Thomas Holhirst, formerly Edward III's collector of the great and small customs in the port of the city of Cork for the said term in the time of the said former T.; and one tally of 62s 4d from the said Thomas, formerly collector of said customs in the port of the city of Dublin, in Easter term 49 Edw. III [1375] in the time of brother Thomas Scurloke, abbot of the house of St Thomas the Martyr near Dublin, then deputy of the said former T.; and also one tally of £14 from the said Thomas Holhyrst, formerly collector of the said customs in the port of the town of Drogheda, in Hilary term 50 Edw. III [1376] in the time of the Alexander, bp Ossory, then T. in that land; and also one tally of 100s from the said Thomas Holhyrst, formerly collector of customs in the port of the city of Cork in Hilary term 50 Edw III [1376] in the time of the said bishop, then T., as is said. And John received none of the money contained in the said tallies from the said Walter and Thomas Holhirst before the death of Edward III, nor could he receive it afterwards by reason of the K.'s death.

The K. wishes to provide a suitable remedy to John More in this part. ORDER to receive and destroy the said tallies from John, so that Walter and Thomas Holhyrst can obtain no benefit or allowance from them in the future; and they are to cause to be made to John More due assignment or payment from the K.'s treasury of the said sums.

Wishing lately to be informed concerning the arrears of James Penkeston, formerly keeper of the writs, rolls and memoranda before the Jcr of Edward III, the late K., grandfather of the present K., of his fee of 100s p.a., and of 5m that Edward III granted to James, formerly keeper of writs and rolls in Edward III's bench in Ire. for the maintenance of clerks of James labouring in Edward III's service in the writing of rolls and indictments, the K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. from that time, returning their findings to the K. in chancery. They returned that it is agreed that the arrears of James's fee of 100s from 23 July [1376] 50 Edw. III until 20 June [1377] following, viz. three quarters of a year and 58 days, amount to £4 10s 8½d; and that his arrears for that time of those 5m amount to 59s ¾d. Wishing that satisfaction be made to James of the said sums, ORDER to pay him the £4 10s 8½d and the 59s ¾d.

James Butler, e. Ormond, Jcr, pleads that on the next Wednesday after St Francis last [7 Oct. 1377], he received a commission of the office of Jcr of Ire., taking £500 p.a., sent to him by the K. to Kilkenny because by the K.'s letters of p.s. then directed to the earl, the K. asked him to hold the said office by the form and effect of the said commission for the security and defence of the land, until ordered differently, to the K.'s honour and to maintain the K.'s status.

The Jcr, considering that the 20 men-at-arms of his retinue specified in that commission does not and cannot suffice for the governance of that office and the safety of the land, retained Robert Thame and Edward Perrers1 with 7 men-at-arms and 67 archers from Eng. in their company to stay with him for the wars in the said land, beyond the 20 men-at-arms. The earl paid fees and wages for these men until 21 Jan. [1378] last of his own money, without receiving anything from the K.; and he also paid of his own money, to his impoverishment, £26 to Tyrelagh Obreen, chieftain of his lineage, and £39 15s to Arthurus s. of Dermicius McMurghe and Arthurus s. of Geraldus McMurgh in order to retain them for the K. in those wars for that time. He seeks payment of his fee for that time, and of the said sums paid out by him.

On the advice of the council of Ire. and wishing to grant his plea, ORDER to pay the earl the arrears of his annual fee from the said Wednesday, and also £50 in part recompense for the payment of the fees of the men-at-arms and archers retained beyond the 20 men-at-arms specified in the commission; and also the £26 paid to Tyrrelagh and £39 5s paid to the said Arthurus s. of Dermicius and Arthurus s. of Geraldus.

[After 8 Mar. 1378]

MEMORANDUM that Jcr, C., T. and others of K.'s council in Ire., and the prelates, magnates, nobles and commons of the K.'s land of Ire. in parliament summoned and held at Castledermot on the next Monday after Ash Wednesday last [8 March 1378] , treating and consulting together among other things about how Murgh Obryen—who is now in Leinster with a great force of Irish of Munster and proposes to wage war on the K.'s lieges in Leinster in aid of his Irish enemies of Leinster, to destroy and waste with his force (may that be averted!)—might best and most speedily be removed from Leinster with his said force; so that henceforth as little injury as possible might be inflicted on Leinster and on the K.'s lieges there.

Considering the damages and destruction that Murgh could easily inflict on Leinster with his force should he stay there longer without any resistance, it was agreed and ordained with the advice of those there [assembled] that he should have 100m on this condition, viz. that he withdraw from Leinster to his own parts with his force without delay, without any injury being done by him or his followers to Leinster or the K.'s lieges there now or ever in the future. The said Murgh took his corporal oath upon the Holy Gospels to do this before the said Jcr, C., T. and council. Whereupon the clergy, magnates and commons of cos. Dublin, Kildare, Kilkenny and Wexford freely granted 100m, except 9m, to be paid for the use of Murgh for the said reasons, to be levied from the clergy and commons, viz.

from the clergy of the diocese of Dublin, 12m;
from the clergy of the diocese of Kildare, 6m;

The K. sent Nicholas Dagworth kt to Ire. to supervise the governance of the said land and the proceedings of the K.'s ministers and officers there. The K. learned that Nicholas Moenes, one of the officers appointed by the late K. [Edward III] there, intended to depart the land and ordered him by writ dated 6 Feb. 13781 not to presume to cross to foreign parts as it would hinder the business with which Nicholas Dagworth is charged.

MEMORANDUM that on 24 March [1378] following William fitz William and Roger Kylmore mainprized on pain of £100 in the chancery at Castledermot to produce Nicholas Moenes before Nicholas Dagworth kt, or in the case of his death, before any of his associates named in the K.'s commission, around Easter next at Dublin [city], or elsewhere in co. Dublin, where he should please to appoint a day, giving six days notice. If they fail to do so, they are to surrender themselves to confinement in prison until Nicholas Dagworth has informed the K. in Eng. and received answer concerning what should be done in the premises. And the said Nicholas Moenes firmly bound himself not to alienate his lands [etc.] in the meantime.2

Castledermot
To the T. and chamberlains of the Ex.

The former ministers of the Ex. of Ire. of Edward III, late K. of Eng., grandfather of the present K., have shown by their petition displayed before the K.'s beloved and faithful cousin, Lionel duke of Clarence, formerly Lt of Edward III in the said land, and others of the K.'s council in his parliament held at Kilkenny on Thursday, the morrow of Ash Wednesday 40 Edw. III [19 Feb. 1366], that it was agreed and ordained by Edward III and his council of Eng., and by the common assent and will of the prelates, magnates and peers together with the whole community of the said land of Ire., that the K.'s Ex. should sit at the town of Carlow, in relief of that town and those parts of co. Carlow in its vicinity, which were almost totally burned and destroyed by the Irish of Leinster, enemies of Edward III.

The K.’s ministers, who were compelled to come from their own places and homes and sit there in the K.’s service, could not be provided with victuals for their sustenance owing to the remoteness of the town and its distance from their homes. Therefore, since they were accustomed to be sustained by the fees of the K.'s officers from the time when the Ex. was at Dublin, and because of the paucity and scarcity of all manner of victuals owing to the many faithful people of Edward III from various parts of Ire. flocking to the same Ex. and staying there for some time, they were not able to live comfortably from their ancient fees which they received from Edward III before this time while his said Ex. was at Dublin, nor could they maintain an appropriate estate, each according to his own, to the nullification of the ministers and their manifest impoverishment. Whereupon they pleaded to Edward III to provide for their better sustenance for the time that the said Ex. should remain at Carlow. The K., truly considering the premises and assenting to their pleas, as is right, by deliberation of the council, granted the following annual rewards beyond their ancient fees, to be received from the Ex. annually in equal portions at the terms used in the said Ex. for paying the fees of ministers, for all the said time, viz.:

the chancellor of the Ex., 5m;
the chief baron of the Ex., £20;
the second baron of the Ex., 10m;
the third baron of the Ex., 10m;
the chief chamberlain of the Ex., £10;
the second chamberlain of the Ex., 10m;
the chief engrosser of the Ex., £10;

the clerk of the T. writing rolls and tallies in the receipt of the said Ex., 5m;

the transcriber of copies, 40s;
the chaplain celebrating divine services in the chapel of the Ex., 50s;
and the marshal and usher of the Ex., 5m.

And, on 28 March [1366] following, the K. ordered by a writ addressed to the then T. of Ire., or his Lt, and the chamberlains of his Ex., that they should pay those sums of money annually from the K.’s treasury from term to term.

And because the ministers of the K.’s Ex. of Ire., personally appearing before the K.’s beloved cousin, James Butler, e. Ormond, Jcr of Ire., and others of the K.’s council there, in a great council held at Castledermot on the morrow of Hilary 1 Ric. II [14 Jan. 1378], showed that they could not in any way serve in their offices nor could they maintain an appropriate estate, each according to his own, unless the present K. should see fit to grant to them those annual fees and rewards that Edward III granted annually to his ministers while his Ex. was at the said town of Carlow, to be received at the Ex. in equal portions at the terms used in the said Ex. for paying the fees of ministers for as long as the Ex. should remain at the town of Carlow, just as Edward III’s ministers received them. Wishing to act graciously towards those ministers and by the advice and assent of the said Jcr and council, the K. granted to them those annual fees and rewards that Edward III granted annually to his ministers of the Ex., as is said before, to be received at the Ex. in equal portions at the terms used in the said Ex. for paying the fees of ministers for as long as the Ex. remains at the town of Carlow, just as the said ministers of Edward III received them, just as appears in a certain agreement made on this by the Jcr and council there, which was enrolled in the rolls of the K.’s chancery of Ire.

ORDER to pay the said ministers those fees and rewards for as long as the Ex. remains at the town of Carlow.1

The K. has learned by an inquisition lately taken and returned into chancery that Stephen Marreys held no lands or tenements at the time of his death in chief of Edward III, the late K. of Eng., but that he did then hold in his demesne as of fee the manor of Clogher, co. Tipperary, of the earl of Ormond, as of his manor of Moyalvy by 20s royal service when scutage runs. The manor is worth nothing, however, as it has been wasted by the Oboynes and Omolryans, Irish enemies of the K. The jury was ignorant of the time of Stephen's death, since he died in Eng. [some six or seven years ago]. James Butler, e. Ormond, Stephen's kinsman, is his next heir in the following manner, viz. William Marreys kt, ancestor of the present Stephen, whose estate descended to the said Stephen by right of inheritance, died seised of these lands leaving a son, John, and a daughter, Joan. John succeeded and bequeathed the same to his son and heir, Herbert Marreys, father of the said Stephen, who himself dying in seisin, bequeathed them to Stephen, father of the last holder, who has now died without issue. Therefore, by right of inheritance the lands now fall on the right heirs of William's daughter, Joan, who married Theobald [II] Butler; and they had issue Theobald [III] Butler, to whom the lands fell in right of his mother; and Theobald [III] had issue Theobald [IV], father of Theobald [V], father of Edmund, father of James Butler, father of the said earl of Ormond, who was next heir of the said Stephen Marreys.1 ORDER to Robert Luchteburgh, escheator of Ire., to remove the K.'s hand from the premises and deliver them to the earl of Ormond.

Thomas [Dene], bp Ferns, was formerly farmer of all the lands and tenements that Mary St Paul, late countess of Pembroke, held in dower or otherwise of the inheritance of John Hastings, late earl of Pembroke, in co. Wexford on the day he died, which are in the K.'s hand by reason of the death of the countess and the minority of the heir. On 14 June [1377], Edward III, late K. of Eng., granted custody of all the said lands and tenements to William York, his esquire, until the heir reaches his majority, and so from heir to heir.1 And on 10 Aug. [1377] the K. ordered the Jcr to allow William the custody and issues from 14 June. ORDER to pay William the issues that you have collected from the custody of the said lands and tenements from 14 June 1377.

In the octaves of St John the Baptist 48 Edw. III [1 July 1374], Edward III, late K. of Eng., grandfather of the present K., in the K.'s court in Ire. before the K.'s beloved and faithful William Windsor, then governor of his land of Ire., recovered by means of a writ of quare impedit his right of presentation to the church of Ardcath in the diocese of Meath against the then prior of Llanthony Prima in Wales, which church the prior asserted that he and his predecessors had held for their own use from time immemorial. And the same prior pleaded to Edward III that since various errors had occurred in the record and process held on this, the same K. might wish to revoke and annul his judgement justly rendered on account of those errors. And Edward III, desiring that justice should be done in this part both for himself and for the prior, caused the record and process and all things pertaining to it to come before him in Eng. for that reason. That prior ceased to be prior while his suit was still pending, as was said; and later by suit of John Yatton,1 the present prior, taking his place, it was asserted that various errors had occurred in the record and process, to the damage of the present prior and the manifest danger of disherison of his house; and he pleaded to Edward III to revoke his judgement justly rendered on account of those errors.

Edward III by his writ ordered the then Jcr of Ire. to notify Robert Sutton clk, who occupied the said church, as was said, to be before the K. from Holy Trinity and for the following 15 days, wherever the K. might then be in Eng., to hear the said record and process. Edward III gave that day to the prior, who appeared at Winchester before the K. on the given day; and Robert did not come, although he had received sufficient warning and was solemnly called on the fourth day of the plea. For this reason, Edward III, having seen and diligently examined the said record and process, revoked and annulled the judgement rendered there on owing to various errors appearing in same record and process; and he further considered that the same prior should be restored to the advowson of the said church and possession of the same, and that he should have the same estate in the advowson and possession of that church as his predecessor had before the said judgement was rendered against the then prior in error, saving only the rights of Edward III, as appears to the K. by inspection of the record and process held in the time of Edward III. And on behalf of the present prior, the K. has now learned that although judgement was rendered, execution of that judgement has yet to be made. And because the K. wishes that those things that were duly enacted in Edward III's court should be put into effect, the K. has ordered his Jcr of Ire. to cause the prior to have the same estate in the advowson and possession of that church as his predecessor had before the said judgement was rendered against the then prior in error, and that he should command the diocesan of the place to do what pertains to him without delay in making restoration to the prior. ORDER to cause restoration to be made to the present prior, so that you put into effect without delay that which pertains to the K. in this part in the said form.

III1 and endorsed by them. The K. sends the petition to the T. and barons of the Ex. ordering that they are to establish by inquisition whether the petition contains the truth; if so, the bishop is to be exonerated of the 100m specified in the petition, and he is not to be summoned to the Ex. to answer for that sum.

Robert s. of Philip Prendergast has shown by petition displayed before the Jcr and council in the K.'s parliament held at Castledermot on the next Monday after Ash Wednesday last that although Edward III, late K. of Eng., grandfather of the present K., on the advice of his council in Ire., granted 10m to Robert in recompense for his damages and losses sustained in Edward III's service, and ordered the T. and chamberlains to pay Robert those 10m, Robert still has not obtained the sum or assignment of debts owing to Edward III or the present K. until now. He seeks payment. ORDER to pay Robert the 10m or make him assignment in debts, by virtue of Edward III's order.

The K. wished lately to be informed concerning the amount of arrears owed to Robert Lughteburgh of those 10m granted to him by Edward III for his expenses, and those 100s granted to him for good service in serving as collector and receiver in cos. Louth, Meath, Dublin, Kildare and Carlow of various subsidies granted to Edward III in aid of the K.'s wars in Ire. when William Windsor was Lt of the late K. The K. ordered the T. and chamberlains to search the rolls and memoranda of the Ex. from the time of Edward III, returning their findings to the K. in the chancery of Ire. They returned that the arrears of the 10m amount to 66s 4½d, and the 100s is entirely in arrears. Wishing that satisfaction be made to Robert, ORDER to pay him the 66s 4½d and the 100s.

They returned that it is agreed that John's arrears from 8 Nov. [1374] 48 Edw. III until 8 May [1375] following, viz. half a year, amount to 10s; and his arrears from 8 May [1376] 50 Edw. They returned that it is agreed that the arrears of the C. of his fee from 3 June [1376] 50 Edw. III until 3 March [1377] following, viz. three quarters of a year, amount to £4; and from that 3 March until 20 June [1376] following, viz. a quarter year and 16 days, they amount to £11 13s; and the arrears of the said wages from 1 April [1377] 51 Edw. III until 20 June following, viz. 81 days, amount to £48 12s. Wishing that satisfaction be made to the said C. for those sums, ORDER to pay him the £4, £11 13s, and £48 12s.
